EPA's Waters of the US Proposal Introduces Costly Burdens for Forest Landowners

In late spring, the Environmental Protection Agency (EPA) and the U.S. Army Corps of Engineers (Corps) released a proposed rule that identifies the waters that are jurisdictional under the federal Clean Water Act (CWA).

The proposed rule would redefine the scope of federal power, expanding the list of water features subject to regulation under the CWA.

This proposed expansion of Waters of the United States (WOTUS) introduces costly new administrative burdens for states and forest landowners.

The 2014 Forest Landowner Policy Summit will provide updates on policy such as the proposed expansion of WOTUS defined under the CWA and the impact it will have on forest management practices.

The proposed expansion also creates considerable legal uncertainty over where water quality stands and total daily maximum loads apply. The expanded definition will create considerable uncertainty over where mandatory Best Management Practices (BMPs) for certain forestry activities will apply.

The expansion of WOTUS invites citizen lawsuits which can be costly and disruptive to forestry operations, and can cerate significant and prolonged economic uncertainty.
