UNCITRAL Rules on Transparency in Treaty-based Investor-State Arbitration

The UNCITRAL Rules on Transparency in Treaty-based Investor-State Arbitration are now published on the UNCITRAL website here. It is notable that in any arbitration in which the Rules apply pursuant to a treaty or an agreement by the parties to a treaty, the disputing parties may not derogate from the Rules unless the treaty allows them to do so.
