People buy new strata properties for the convenience, the investment return but also because they expect a lower maintenance requirement for a while. Due to legislation being very prescriptive in relation to environmental considerations, energy ratings, health, fire and safety measures, purchasers do have an expectation that the new pad is a modern, safe environment to live in. Hence it is worrying for our sector to see the reported lack of duty of care in recent years.

The current dispute resolution provisions has resulted in a dispute resolution framework that is in effective and inefficient. Strata disputes will only increase as strata schemes become more common in Western Australia.
Channelling strata disputes into the State Administrative Tribunal will provide all strata stakeholders with access to a cost-effective strata dispute resolution forum, which has the specialist strata expertise and statutory power to efficiently resolve strata disputes.
