AIJA International Arbitration
Newsletter No.43, May 2016

Dear <<First Name>>

We have made it through the Winter into a magnificent Spring!

We hope you all enjoyed the November 2015 Half-Year Congress in the exciting locale of Istanbul.  The scientific and social program took full advantage of the many delights Turkey has to offer.

Next up is the Half Year Congress in the Windy City of Chicago, which takes place from 18 to 21 May 2016.  Don’t forget to join us at the Commission meeting on Friday, 20 May 2016 at 16.00 o’clock. It will again be a great opportunity to get involved with the Commission, say hello to old friends and make new ones.

This Summer our first event is the Advocacy Training Seminar in June 2016 in London.  We are also looking forward to the Annual Congress in Munich, where we will have the benefit of a Working Session on Arbitration and Energy Law and a Workshop on Mediation.  Much gratitude to the General Reporters Marc Krestin, Catrice Gayer, Lucy Gordon and Eleni Polycarpou who are busy putting together the Arbitration Commission General Reports.

Following that the next Annual Arbitration Conference which will take place in the beginning of October 2016 in New York City where we will explore the topic of Strategic Choices in International Arbitration.  Autumn in New York is not to be missed!

We are looking forward to seeing you all in Chicago or soon thereafter.

Best regards,

Pascale, Tero and Hagit

A new window to learn more about international arbitration and arbitrators

Prof. Juan Fernández-Armesto is a very well and world known Arbitrator, having a huge experience in investment and international commercial arbitration.

Sole Arbitrator or a Panel?
Have you ever seen a dissent in a procedure with sole arbitrator?
Ad Hoc or Administered Arbitration?
The moneys are better in hands of a responsible administrator.
Fast Track or more time to assess?
The more time, the more cost.
Expensive or affordable arbitration?
Business men want speed and thrift.
Favorite venue?
Mogadischu.
Waiver of responsibility for an arbitrator, yes or no?
No – otherwise you open the floodgates to criminal investigation.
Partial award, favorable or not?
No – the more awards, the more time, the more cost.
What do you remember of your first experience as arbitrator?
The smell of the Lisbon garbage recycling plant. No way of getting it out of the suit. Had to throw it away.
A funny anecdote
A party that at the last moment decided to change its prayer for relief from compliance of the contract to termination. Just forgot to tell its expert. The expert report was based on the previous assumption that the contract would be complied with. Funny to see the expert invent arguments to defend that the damage calculation was still right !!
One thing you would change in the arbitral practice.
I would change three : Transparency, transparency, transparency.

A special thanks goes to Juan Fernández-Armesto, who accepted to delight in our 10 Shots.
