Kinder Morgan announced new filing date

Kinder Morgan has announced a new filing date of November 20.  Once FERC announces acceptance of this filing, individuals and organizations have twenty one days to file as interveners. This is going to be right around the holiday season between Thanksgiving, Hanukkah, Solstice and Christmas, so preparing to file ahead of time will make it easier to get your filing in ahead of time.

"All-Stars" on last day of Scoping Comments

On Friday, October 16, over 350 comments poured into the NED docket as the Scoping Comment Period came to a close. Aside from volumes of stellar testimony by everday citizens, many official Town Boards and state and federal agencies chimed in as well.

Here are some highlights:
» FERC Staff comments on Kinder Morgan's Resource Reports
» Scoping Statement by the EPA
» Scoping Statement from the MA Attorney General’s office
» Appendix from the MA Attorney General’s office

NED Docket is still open
Even though the formal Scoping Comment Period is over, you can still continue to comment to FERC on the project. Until Kinder Morgan's application is accepted by FERC, the Docket number is still #PF14-22. When it enters formal filing, FERC will give it a new number, and then we'll be pressing them to roll over all 6,000+ prefiling comments under the new number. This usually doesn't happen, but given the degree of community input, we think it should and will be pressing the issue.

Aside from this being a crucial time to help our neighbors in Sandisfield, the Article 97 decision for the CT Expansion pipeline could set a precedent for Article 97 issues for NED and beyond.

NOVEMBER 10TH PUBLIC HEARING DATE SET FOR KINDER MORGAN’S SANDISFIELD ARTICLE 97 LAND BILL

Downing & Pignatelli seeking testimony
from residents and concerned parties

BOSTON
– State Senator Benjamin B. Downing (D- Pittsfield) and State Representative William “Smitty” Pignatelli (D- Lenox) announce that a public hearing date has been set by the Joint Committee on State Administration & Regulatory Oversight (SARO) for H. 3690, An Act relative to the conveyance of an easement in the town of Sandisfield, Massachusetts.

The public hearing is scheduled to take place on Tuesday, November 10, 2015 at 11:00am in Gardner Auditorium of the State House.  It is the only matter being discussed during the hearing.

This legislation was sponsored by State Representative Garrett Bradley (D- Hingham) at the request of the Tennessee Gas Pipeline Company, LLC, a subsidiary of Kinder Morgan Energy Partners.  It is necessary to advance their proposed Connecticut Expansion Project (CT Expansion), as passage of this legislation would secure access and easements to state-owned, public conservation lands in Sandisfield.

As with other hearings, written testimony of any length may be submitted. Oral testimony presented at the hearing is limited to 3 minutes.

In spite of occasional snow squalls and freezing temperatures on the hilltop, over 80 citizens from across western Massachusetts gathered at a Plainfield farm that Kinder Morgan is planning to use as a pipe yard - a large contractors' field where pipeline segments would be stacked and heavy equipment parked during the year and a half of construction of the Northeast Energy Direct pipeline. The rally was held on the same day as a Non-Violent Direct Action training organized by Plainfield Opposes the Pipeline (POP) at the Plainfield Town Hall.
