Ken Simonson, Chief Economist, AGC of America Set to Present Keynote Address at 2016 AIC Annual Forum

 
The AIC is excited to announce Ken Simonson as a Keynote Speaker for the 2016 Annual Forum.  

Ken Simonson has been the chief economist of the Associated General Contractors of America, the leading trade association for the construction industry, since 2001. His weekly summary of economic news relevant to construction, The Data DIGest, goes to 47,000 subscribers. He is a Fellow and past president of the National Association for Business Economics, the professional organization for individuals who use economics in their work. Currently, he serves as an appointed member of the Census Scientific Advisory Committee and the Bureau of Labor Statistics’ Data Users Advisory Committee. Ken has 40 years of experience analyzing, advocating and communicating about economic and tax issues. He received a BA in economics from the University of Chicago and an MA in economics from Northwestern University.

AIC Announces Greg Carender, CPC, as President-Elect

 

Alexandria, VA, November 30, 2015 - - The American Institute of Constructors announced today that Greg Carender, CPC has been elected as its next National President.  Carender, will serve as AIC’s President-Elect until his term of 2 years begins February 27, 2016. 

Greg is employed by PricewaterhouseCoopers and serves as a Consulting Director within PwC’s Capital Projects and Infrastructure division.  Greg became a Certified Professional Constructor in 2008 and has served in various leadership positions within the AIC, most recently as it’s Vice-President.  He previously served as the AIC Treasurer and Chairman of the Marketing Committee.  As Vice-President, he has championed a new grassroots initiative, AIC State Representatives, which aims to provide more localized services and opportunities for AIC Members to connect and contribute to the AIC organization. 

In addition, AIC announced that Brian Holley, a Project Executive with San Diego based Rudolph & Sletten has been named incoming Vice-President, Terry Foster, CPC, a Professor at the University of Nebraska – Omaha will assume the officer position of Secretary, and Mark Hall, CPC of Hall Construction in Howell, NJ will serve as AIC’s Treasurer beginning in 2016.

Mr. Ethics - November 2015


Dear Mr. Ethics,
 
We are the architect of record for a hospital, new construction project.  Our contract calls for us to be the initial decision maker for any contractor disputes that arise on the project including any claims that allege errors and omissions against us.   The general contractor wants that provision stricken from the project agreements because they believe that we should not be ruling on our own potential errors or omissions.  They argue its patently unethical.  I think their request is insulting.  We can render unbiased decisions.  What do you think about the request?

Dear Insulted,
 
I am sure that you can ethically carry out your obligations under this provision but this may be one request you should support.   Perceptions can be stronger than reality when it comes to acting ethically.  Even if a ruling is unbiased a perception is still going to be that you were covering an exposure of liability that you committed.  Moreover, if you determine that an error or omission did occur you could be considered to have admitted liability for any costs incurred as a result of same.  Admissions of liability, if made without the consent of your professional liability carrier may result in your coverage being voided.  Although you are committed acting in an ethical manner, and perceptions of impropriety may be unethical in themselves, you may want to consider the general contractor’s request.  Sometimes it may be better to decline a responsibility so long as it is not unethical to do same.  This may be one of those times.
