In 2016, Miller, Miller & Canby will celebrate 70 years of serving the legal needs of our community. As the oldest law firm in Montgomery County, we are proud to celebrate our firm's history. We also recognize that this milestone is in many respects due to the relationships we have built and maintained with you, our clients, friends and the business community. For many, these relationships have been long-standing and span multiple generations. So, as we celebrate our firm's anniversary in 2016, we also celebrate our relationships with you, and the continued trust that you have placed in us to represent and counsel you in your business and personal affairs. PURPLE LINE UPDATE: RESIDENTS ALONG PATH OF PROPOSED PURPLE LINE TOLD TO MOVE FENCES & SHEDS
The Washington Post reported on January 6 that some Maryland residents along the planned route for the light-rail Purple Line are being told that they have until April 30 to tear down fences, sheds and anything else built on publicly owned land preserved for the project. As the article confirms, Maryland is moving full steam ahead with the property acquisition process in order to acquire the property it needs to be able to begin construction as soon as the preferred contractor is chosen and the contract finalized later this year.

MARYLAND ISSUES NEW PROPERTY TAX ASSESSMENTS: COMMERCIAL PROPERTY OWNERS HAVE UNTIL FEBRUARY 11TH TO APPEAL
In late December, the Maryland Department of Assessments and Taxation (SDAT) issued new Assessment Notices to owners of one-third of all commercial properties in Maryland. Property owners have 45 days from the date of the Assessment Notice to challenge these new assessments. The “first-level” appeal allows the owner the opportunity to convince the assessor that the assessment is incorrect. If the assessor refuses to reduce the assessment, the owner may file a further appeal within 30 days to the county Property Tax Assessment Appeals Board (PTAAB). The Board will consider the evidence and issue a written decision, usually within two weeks. If the property owner is still dissatisfied, another appeal may be filed to the Maryland Tax Court.

CHANGES COMING IN VETERANS BENEFITS FOR 2016
2016 will be bringing numerous changes to both process and eligibility with respect to levels of benefits for which veterans may apply.

TAKE ADVANTAGE OF GUN TRUSTS BEFORE REGULATORY CHANGES TAKE PLACE IN JULY 2016
A Gun Trust is a trust created specifically to own firearms in compliance with the National Firearms Act (NFA) and specific state and local laws. The purposes of a Gun Trust are several fold: it reduces the red tape necessary to acquire certain firearms, it allows the beneficiaries to use and enjoy the firearms, and it avoids the difficulties of transferring firearms on the death of a primary beneficiary.
If an individual wishes to acquire certain firearms, federal law requires that he or she must be fingerprinted, have background checks performed, and have the Chief Law Enforcement Officer (CLEO) in the individual’s jurisdiction sign off on the necessary paperwork and send to the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF). This red tape is not only burdensome, but in many jurisdictions, CLEO’s simply refuse to sign off on the necessary paperwork. These requirements currently only apply to individuals and not to entities.
