The pharmacy profession today is evolving at a rapid pace. The profession has matured, technology has progressed, and demand is increasing exponentially. The flip side is that the profession must comply with an array of legislative and regulatory requirements. Now more than ever, in order to succeed the pharmacy must have an innovative marketing program and enter into strategic joint ventures and business arrangements. This program will discuss the legal parameters that must be followed when implementing a marketing program and entering into joint ventures and arrangements with referral sources. Among other issues, the program will discuss the Medicare anti-kickback statute, the Stark physician self-referral statute, the beneficiary inducement statute, the telephone solicitation statute, safe harbors, OIG fraud alerts, and state anti-fraud statutes. The program will discuss medical director agreements with hysicians, joint ventures with hospitals and other providers, subsidizing a physician’s travel expenses to a conference, utilization of employee liaisons, avoiding “sham” clinical studies, avoiding arrangements with marketing companies, and utilization of W2 employee marketing reps (rather than 1099 independent contractor marketing reps).
