Priya's Story

Priya is a single mother raising two sons with cerebral palsy, both of whom are wheelchair-bound.  When their school district failed to provide what was needed for her sons’ educations, Priya was referred to Legal Services of the Hudson Valley.
 
Priya’s youngest son, Ashish, requires a twelve-month school program so that the skills he gains over the school year do not regress over the summer.  Initially, the school district was reluctant to provide this program for Ashish, but a Legal Services of the Hudson Valley attorney was successful in obtaining year-round academic and related services such as occupational, speech, and physical therapy, so that Ashish’s education is able to progress.
 
For Priya’s oldest son, Ryan, the school district had recommended a piece of equipment called an EZ Stander to stretch out his legs – something that is very important for a person who is wheelchair-bound.  The school district had also recommended that Ryan be given an assistive communication technology evaluation because he is unable to communicate verbally, and this device would make it possible for Ryan to communicate with students and staff.  Regardless of the school district’s own recommendations, it refused to provide these technologies.  A Legal Services of the Hudson Valley attorney represented Ryan at a special education meeting and the school district agreed in writing to provide the EZ Stander and assistive communication device, but again failed to deliver.  Ryan’s attorney filed a due process complaint under the Individuals with Disabilities Educational Act, and the school consequently provided the technologies that Ryan needs to fully access his curriculum and do well in school. Speaking of Ryan’s case, Priya says that the victory “has opened up his world” educationally and socially.
