President's Message
 As mentioned in the March Presidents Message, the Tennessee Health Information Association (THIMA) executive board attended the AHIMA 2016 Advocacy Leadership Symposium and Hill Day in Washington, D.C. on April 4th and 5th. On April 4th we had a great line up of speakers on understanding the importance of advocacy at the local, state and national level.
We also heard from Deven McGGraw, Deputy Director, Health Information Privacy, Office for Civil Rights, Health and Human Services (HHS) and Lucia Savage, Chief Privacy Officer, Office of the National Coordinator for HIT, about the work currently being done in privacy policy, enforcement, and opportunities for HIM advocacy. Lynn Thomas Gordon discuss the AHIMA Advocacy Toolkit available to CSA’s for advocacy efforts.
On Tuesday, April 5th THIMA board participated in AHIMA Hill Day and Tennessee Tuesday. As we meet with the staff of our Tennessee Senators and Congressmen we advocated for a national voluntary patient safety identifier.
The AHIMA grassroots advocacy campaign that ran from March 20 thru April 18, 2016 received 8,799 signatures. Pam Lane, VP of Policy and Government Relations at AHIMA has reported that “AHIMA was mentioned in 72 different media sources in March with audience estimates of slightly less than 7 million. And our Twitter rally on March 24 was estimated to have reached 12 million timelines! These are astounding numbers! There was no doubt that we were carrying the message forward on behalf of the patient.â€
There is tremendous activity in healthcare and the health information management arena. One of the recent changes that is impacting many HIM leaders and release of information vendors is the recent guidance from Health Human Services (HHS)/Office for Civil Rights (OCR) regarding patient access to their medical record, including but not limited to, allowable charges for providing copies of patient records, patients right to request how the copy of the records can be provided. THIMA has shared information to the guidance in previous THIMA eNEWS. Additionally, HHS/OCR has launched Phase 2 HIPAA Audits, and not surprising, patient right of access is one area of focus of the audit.
In May, the THIMA Board will meet for the annual Strategic Planning meeting which will be held this year in Chattanooga, Tennessee. I encourage you to read the THIMA eNEWS communication when you receive it and to visit THIMA.org frequently to stay current on events and activities.

TN Identity Theft Deterrence Act Amended - Mandates Notification of Data Breaches within 14 Days
Companies and organizations – including employers, healthcare providers, retailers and others – that experience data breaches which involve their customers’ or employees’ identities have significant new obligations under a recently amended Tennessee law, including a 14-day deadline to notify affected individuals, even if the breach involved encrypted data.
Recently signed into law by Governor Bill Haslam, Senate Bill 2005/House Bill 1631 takes effect on July 1, 2016 as Public Chapter 962 and amends Tennessee’s Consumer Protection laws with respect to data breaches. As amended, the law now requires a business to notify Tennessee residents of a breach of a security system or unauthorized access to personal information no later than fourteen (14) days after discovery. Such breach or unauthorized access applies to all data – encrypted or unencrypted.
In addition, the amendment adds a definition of an “unauthorized person,†which is an employee who discovers the information and intentionally uses it for an unlawful purpose.
Because the amendment specifically removed the word, “unencrypted,†from the statute, it remains to be seen how this revision will affect security protocols and policies, especially as executive teams across the nation strive to establish secure, robust IT infrastructures. ​
