EXECUTIVE OFFICERS – A REMINDER FROM THE OEA

The Office of the Employer Adviser is seeing a number of inquiries from construction employers who have been assessed retroactively for unpaid executive officer premiums. This is a reminder that since 2013 the Workers’ Compensation Act requires all executive officers or partners to pay premiums on their insurable earnings. This is regardless of whether the executive / partner is working in construction, stays in the office, or is enjoying her retirement in a warmer climate. If an executive / partner is issued a T4 or a T5 or paid in some other manner, the company must pay premiums on their earnings.

If the WSIB audits the company and realizes that premiums have not been paid, the company will be retroactively assessed for the current year plus two prior years. This could be a lot of money. We recently had a company call us in this unhappy circumstance as they had a $90,000 bill from the WSIB for non-payment of executive officer premiums. But there is a simple and quick solution.

If your company has executive officers who are not doing construction work, then one of them can opt out of paying premiums all together, and any other executives who don’t do construction work can take advantage of paying in Rate Group 755 which charges a premium rate of twenty-one cents. To do this log on to the WSIB’s website and look for the employer forms page or simply Google WSIB employer forms. Look for Form 1209A – the Request for Rate Group 755, or Form 1208A - Partner or Executive Officer in Construction Exemption from Coverage. And one final word of caution; if you think you have found a loophole around paying premiums it probably will not stand WSIB audit scrutiny. Please check your status with your legal adviser to ensure you are in compliance with the Act, or call the OEA at 1 (800) 387-0774

City of Hamilton Building Permits for March 2016

In March 2016 the City of Hamilton issued $122.28 million in building permits.  For the month the residential component was strongest accounting for 84.77% of the month's total and valued at $103.66 million. The commercial component accounted for 10.09% or $12.34 million, industrial activity accounted for 2.70% or $3.31 million and institutional activity accounted for 1.38% or $1.69 million.

Ministry of Labour Report for March 2016

March saw one fatality in the construction sector when ice from an excavation wall fell on a worker resulting in death.  The month also saw 6 critical injuries, 3 of which were the result of falls.  There have been 21 critical injuries so far in 2016 - 11 the result of falls.

HHCA Hosted DCC Session  

On April 26 Defence Construction Canada was on hand to speak with HHCA members and local construction companies about their move to e-Bidding and e-Bonding. The roll-out of e-Bidding has begun across Canada and will hit Ontario within the next week or so. DCC will continue to use Merx for the solicitation and delivery system of tenders. Wire transfers will be available sometime in May 2016 and e-bonding does not have a release date as of yet but will follow. Bidders of DCC projects will be able to obtain e-bonding through Mobile Bonds or Xenex Enterprises. Companies are encouraged to contact their surety company for assistance.

The e-Bidding system will require bidders’ to use their authorized Merx pin (provided by Merx and can be obtained by clicking here). This PIN is assigned to the company, not the user, therefore only one is required. The system will also include a countdown clock that will tell bidders how much time remains until tender close and a verification feature that will allow DCC to verify the authenticity of the bid bond.
