It seems none of us can avoid reviewing LRBAs and related party loans, with the ATO releasing in mid-April a guidance that provides clarity around the terms that the ATO will accept as arm’s length. This is an important reminder ahead of the June 30 deadline which is just around the corner.
 
In keeping with the “review” theme for this issue of Acis All Areas, we also look at the considerations you need to work through with your clients when deciding whether or not to make a family trust election. The Acis Discretionary Trust checklist is very useful in assessing the benefit of an FTE to your clients.

We’ve also taken a good look at why there is nowhere to hide when it comes to voluntary company deregistration. This is only one side of the equation, and we have a follow up article appearing in the next issue of Acis All Areas. Just to get you started, we look at whether the courts can reinstate a company in the public interest to recoup tax debts.
