FMCSA crash accountability study released

FMCSA released its crash accountability study examining ways to address crashes that motor carriers did not cause, in the context of their CSA scores. The study examined the feasibility of using police accident reports (PARs) to make crash accountability determinations and whether doing so would help CSA better target unsafe carriers. The report concluded that, while it is possible to use PARs for this purpose in some cases, the process would be onerous and not cost-beneficial by the agency’s estimate. 

ATA has renewed its call for FMCSA to remove from consideration in CSA those crashes where it is obvious that the professional truck driver and motor carrier were not responsible for the event. 

FMCSA is seeking comments on the study report. Submit comments here by Feb. 23, 2015, referencing ID: FMCSA-2014-0177. 

Executive in Residence: Tom Hastings

Tom Hastings, President and CEO of TSL Logistics, Ltd, is Wayne State College's School of Business and Technology's "Executive in Residence."

Hastings founded TSL, a domestic and international intermodal corporation in Omaha in 1981.  
He is the 13th recipient of this annual award.

Safety Notice: Welding on cargo tanks

The USDOT/FMCSA is issuing this safety notice to remind all companies of the dangers associated with cleaning, repairing, testing, and inspecting cargo tanks.  These cargo tanks may contain hazardous materials, even if only in trace amounts.  FMCSA has been advised of an increase in the number of incidents related to working on cargo tanks.

Advanced preparation and particular safety protocols should be followed when working on this type of equipment.  Special attention needs to be given in determining what the cargo tank contains or last contained, and ensuring that the cargo tank has been sufficiently cleaned and purged of all hazardous materials before work is initiated.  This includes ensuring that void spaces between compartments and vapor recovery systems are thoroughly cleaned.  See 49 CFR Section 180.413(a)(2) and Section 177.854(g) and (h).

To reduce the possibility of an explosion or inhalation injury, it is required that employees who conduct inspections, tests, or repairs of cargo tanks receive proper hazardous materials training as required by 49 CFR Part 172 Subpart H (Sections 172.701-704).  This includes regular training to keep employees safe, especially if working in shale and oil operations.

IRS Provides Guidance of Fuel Extenders  

The federal Internal Revenue Service has issued guidance for taxpayers who can take advantage of the tax breaks related to alternative fuels that were extended by Congress at the end of last year.  A variety of credits offered under Internal Revenue Code sections 6426 and 6427 for biodiesel manufacture and the sale or use of other alternative fuels expired at the end of 2013, and the recent Congressional action extended them, but only through calendar 2014, after which they have once again expired.  (This has happened before, and IRS issued similar guidance on at least the most recent such occasion.)  Congress provided for a six-month window in which those eligible for the fuel credits for 2014 could apply for them.  Included among the extended provisions is the 50-cent per-gallon fuel tax credit for the use of propane in forklifts.  The IRS guidance says that all claims must be filed by August 8, 2015, and specifies the various forms, schedules, and information needed before the agency can pay a refund or apply a credit.  The guidance is to be found in IRS Notice 2015-3, issued January 16, 2015, and available on-line here:  http://www.irs.gov/pub/irs-drop/n-15-03.pdf.
