On 9-10 July ECAS co-organized together with the AIRE centre a training seminar and a roundtable workshop under the Invisible EU Migrants project, funded under the European Program for Integration and Migration (EPIM).

The training seminar which was largely attended by legal practitioners and NGO representatives was opened by ECAS' Executive Director Assya Kavrakova. Guest speakers from our partner organisations then introduced the audience with the situation of EU migrants who are facing difficulties while exercising their freedom of movement. Focus was put on recent case law of European Court of Justice and on how the judgements Zambrano,  Chen and Teixeira & Ibrahim are being implemented in certain Member States.

The Roundtable on EU Free Movement & Citizenship for Policy and Decision Makers held on the following day was started with a presentation on citizenship, residence rights and discrimination and was followed by a discussion on equal treatment, access to social advantages, social security and jobseekers' benefits and the necessity of showing a sufficient link to the host Member State. Special attention was being paid to the key issues in Belgium.

International Students and Migration Figures: In or Out?

The Conservative Government emerging from the 2010 general election in the UK introduced several policy changes to reduce the net migration target below 100,000 in the country, restricting each of the three main routes by which non-EU nationals can apply to come to the UK, namely: work, family members and studies.

A recent study by the Migration Observatory at the University of Oxford analyses whether or not international students should be counted in the net migration target and the reasons behind such a policy choice.

On 20 July 2015 EU Ministers for Home Affairs met again at an extraordinary Council meeting in Brussels to reach an agreement on the distribution of asylum seekers in the EU, as set out in the European Migration Agenda - an initiative to address the pressing migration crisis in the Mediterranean.

The aim of this permanent relocation mechanism for asylum seekers in need of international protection is to share the responsibility for large numbers of refugees and asylum seekers among the Member States, ensuring a balanced participation in this common effort. This initiative is foreseen in the Commission’s Agenda on Migration following the massive influxes of refugees and asylum seekers arriving at Greece’s and Italy’s shores in the past months.

EU Rights in the Spotlight

In July 2015 the European Court of Justice delivered an important judgement concerning the preservation of residence rights for third country nationals in the event of a divorce from an EU citizen.

The ECJ ruled that a third country national married to an EU citizen may retain their right to residence in a Member State other than the EU citizen’s own State even if his/her EU spouse leaves that State, provided that divorce proceedings have been commenced before his/her departure.
