NSW: Can a PROXY (non resident, non owner) be nominated for an Executive Committee member position at AGM?
We received this question from one of our valued subscribers on a recent article written by Allison Benson, Kerin Benson Lawyers. Allison was kind enough to supply the following response:
The answer is that in NSW anyone can be nominated for the executive committee provided they (the non-owner) consents to the nomination. Any lot owner (or proxy if they have the power) can nominate an EC member.
So, at the meeting, if the proxy (or any other non-owner) is nominated as a candidate for the EC, if they consent to the nomination and get the votes they are on the EC.
