PRESIDENTS REPORT

Greetings FOA Members,
 
To kick off my state of the association address, I am happy and proud to report that your FOA Board of Trustees has returned from a highly successful, short and long range strategic planning meeting. Our meeting could not have taken place at a more fortuitous time since many new  "players" have entered the eye health care arena and have chosen to "dabble" in the profession of optometry.  Unfortunately for the public, there are substantial concerns whether these players have the ability to provide safe and/or effective eye health care in the provision of their services.  Here are a few of these players:
 
1. Opternative has launched an online, self-assessment, refractive eye exam that takes 30-40 minutes to complete and yields an eyeglass prescription for $40.00, or a contact lens prescription for $60.00, signed by an ophthalmologist. 
 
Furthermore, the American Academy of Ophthalmology (AAO) has released a memo to its members in full support of the technology AND warning that they will monitor and oppose any optometry based legislation aimed towards prohibiting its use.

Academy monitoring optometric legislative initiatives seeking to limit ophthalmology’s use of emerging refractive technology
  
An emerging technology platform that allows patients to secure prescriptions for glasses or contact lenses with a web-based app, rather than an in-person visit to a healthcare provider, could shape the telehealth environment—and has the Academy watching how organized optometry might respond on the legislative front.

The 27-state launch of Opternative, a self-directed, online refractive technology system, has the potential to set the market for low-risk, consumer-driven technology. It also could compel organized optometry to mobilize at the state level to block ophthalmology’s use of this and other modes of technology for issuing lens prescriptions. Already, an optometry-backed bill enacted in Maine restricts ophthalmology’s use of this technology.
 
2. Twenty-Twenty Now is another "online eye exam" company that launched recently.
 
3. Dr. Mario Dube, DOM, AP is a Florida licensed acupuncturist who advertises a " vision loss center " that provides diagnostic testing and vision treatment for "dry and wet ARMD, glaucoma, retinitis pigmentosa, diabetic retinopathy and Stargardts Disease."  You may view this "technology" at www.VisionLossCenter.com    
 
...........And these are just a few examples of how new players have decided to 'treat" our patients in Florida via unproven technology and/or the use of the Internet. (Please read my legislative report for further information.)  
 
However, your FOA Board and staff are fully committed and prepared to face and overcome these challenges for the betterment of your profession and for the protection of the patients you serve.  We only ask for your help in three ways:
 
1. Recruit new FOA members;
2. Recruit new OD-EYEPAC contributors;
3. Volunteer your time to serve as a legislative "key person".
 
In closing, I would state for the record it matters not whether you practice in an academic, commercial, or private-practice type of setting, because at this moment the safety and visual health of your patients is at stake. I would also like to personally thank my FOA Board, NOVA, and all of my professional friends who work hard to help me help you.  So please take a moment and act now to help us keep the future of eye health care in Florida safe and bright for all to see.

EXECUTIVE DIRECTOR'S REPORT

The “Speakeasy Soiree” at the FOA convention was a tremendous success.  The convention was held at the historic Breakers Hotel in Palm Beach amid a sea of black and gold décor.

Dr. Ken Lawson was sworn in as the 2015 – 2016 president by past AOA president Dr. David Cockrell. Dr. Stephen Kepley was recognized for his 10 years of service as he stepped down from the FOA Board of Trustees.  The membership elected a new trustee, Dr. Katie Gilbert-Spear of Pensacola.

Members were briefed on the FOA’s legislative priorities at the legislative luncheon by Dr. Lawson and David Ramba, the FOA’s lead lobbyist. The Saturday night banquet was an elegant affair with the guests dressed in 1920s attire, including headbands, hats, sequins, and some very spiffy shoes. MEMBERSHIP DEVELOPMENT COMMITTEE REPORT


We are at a crossroads in our profession.  We must have a united stance regardless of our mode of practice.  Technology has helped us in so many ways inside and outside optometry.  On the flipside, technology can also become dangerous and harm us if used incorrectly or as a “replacement” of services far superior. We cannot allow the care of our patients to become compromised. The FOA is your ally and your voice to continue to fight for their protection.

There are many misconceptions of organized optometry and we often hear pushback from non-members of “What can the FOA really do for me?”  Our answer is “A LOT”.  To expand on this I have copied our mission statement and our summarized benefits from our website below.

FOA Mission Statement:

The mission of the Florida Optometric Association is to advance and promote the quality, availability, accessibility of primary eye care and related health care of Florida's citizens; to represent the profession of optometry; to enhance and promote the independent and ethical decision-making of its members; and to assist and enable optometric physicians to practice their profession so as to ensure the highest standards of patient care.

The FOA strives to bring our members tangible benefits.  Our members-only section offers valuable tools to maximize reimbursements, coding and billing tips to help avoid costly errors and an insight into the legislative issues that we face every day.  The website is also capable of online registration to personally pay for continuing education events, membership dues and for contributions to FOA’s OD-EYEPAC.  We will be continually updating the website with new content to keep you constantly informed.

Help us protect the profession.  Talk to non-members. Educate them on the real benefits.  Become a mentor. Do not tolerate excuses that are not based in reality. Now, more than ever, we must grow the membership and unite.

POF (Professional Opticians of Florida) is providing a 20 hour educational course on refraction.  POF representatives have met with us and have candidly admitted that their intent is to educate opticians on refractions so that POF can then go the Legislature and seek statutory authority for opticians to refract. 1-800 CONTACTS:  This online retailer of contact lenses was able to find a bill sponsor in the Florida Legislature for anti-UPP legislation.  1-800 Contacts has stated in legislative committee meetings in states where they were able to have similar legislation filed that the "branding" of contacts and the optometrist/ patient relationship may lead to an "unfair" retail environment that does not foster price competition. ANTI OD "Study":  A research project is being conducted at the Tulane University School of Medicine in New Orleans for the purpose of compiling adverse incident reports involving optometrists from several states.  Information is being gathered by anonymous complaints. The purpose of the project is to demonstrate “surgical misadventures in optometry."  Check out the Tulane website link to view the details of their "project".

PROTECTING OD ACCESS TO MANAGED CARE:  The "Harkin amendment " which provides for non-discrimination among health care providers by health plans and insurers continues to be challenged by our opposition at the federal level. Upon its passage in 2010, then AOA President Randolph E. Brooks, OD, said in a statement issued by the AOA, “The approval of the Harkin Amendment is a tremendous victory for optometry and will likely prove to be one of the most historic advances in patient access to optometric care since the 1986 recognition of optometrists as physicians under Medicare.”  Since its passage, it has been under attack by anti-optometry advocates but has been sustained by continued vigilance of the AOA and our individual state associations, including the FOA.

EYE ON THIRD PARTY ADVOCACY


The third party issue that is confronting not only optometry but all of health care is ICD-10. There are numerous opportunities to attend course updates around the state. The single most important communication you need to make is to your EMR software company. It is critical that they have your software ICD-10 ready. The next best place we can recommend is the AOA website. They have a series of 10 webinars that are well prepared with presentation handouts and question and answers. This membership benefit alone is worth belonging to the AOA. Adapting to ICD-10 will be an ongoing project for you and your staff to become familiar with this new system.
 
Although I posted this in the last publication of the Insight, the FOA office and the Third Party Committee continue to field calls regarding pay parity. This is the requirement of the third party payer to reimburse equally for all codes regardless of the type of license held. The way most of our members refer to it when raising the concern is pay discrimination. The most common example is when the reimbursement for ophthalmology (OMD) is one amount and the reimbursement for optometry (OD) is lower for the same code being billed. It was a huge victory for the AOA on a national level when we achieved pay parity with Medicare, and it remains the only third party payer to have this requirement. Both Medicaid and commercial carriers do not have this requirement.
 
As we continue to grow as a profession, the need to communicate effectively with third party entities becomes more important. I want to take a minute to remind everyone how important it is to make sure your membership in OD-EYEPAC is up to date. If you are already a member, thank you. The next most important thing is to go out and recruit one of your colleagues to be a member as well.
 
Please continue to communicate with your Third Party Committee regarding the issues you face. You can do so by contacting any of the Third Party Committee members or the FOA office.
