First Attorney Fee Award in China Intellectual Property Court Patent Case
In yet another sign of China’s increased emphasis on intellectual property protection, new information shows that Intellectual Property rights are now resulting in more convictions and penalties than ever before in China.
Guidelines issued by the Supreme People's Court of China in November 2016 created a new norm of higher damages awards against Intellectual Property rights violators.
In a patent ruling made by the Beijing Intellectual Property Court in December, the defendant was ordered to pay a total of $7.2 million in damages which was the highest ever award issued by the court.
The damages awarded included 1 million RMB in litigation costs and was the first time the Intellectual Property Court had awarded attorney fees.
