Tax Problems with
Canada Revenue Agency?

Are you experiencing tax problems with Canada Revenue Agency (“CRA”)?  If you are burdened with serious debt problems, CRA may be only one of several creditors that you have to deal with.

You may see advertisements from tax lawyers trying to scare you into believing that you need their services to deal with CRA debt, however; consulting with a Licensed Insolvency Trustee (“LIT”) may be a much better option for you.

CRA isn’t looking to prosecute you; they are looking to collect money and an LIT is usually your best option for dealing with debt.

File Your Income Tax Return, You Might Get Money Back

Did you know that just by filing your income tax return, you could receive more money from the federal and provincial governments through tax credits and benefits? 

By simply filing your income tax return, a single person may receive approximately $585 more per year, a single parent with one child could receive $4,700 a year, and a two-parent family with two children may receive up to $8,600 more per year.\

What to do if you can’t pay your personal taxes?

 



I owe personal taxes!  I don’t have the money to pay them and my other debts.  What do I do?

The starting point is to understand why you owe taxes.  The next step is to fix it so you don’t owe in future years.

Generally, the main cause of why you owe personal taxes are:

  • You are self-employed and didn’t remit your tax installment That means you are spending the money you should be saving for taxes.
  • When you have multiple jobs, typically the taxes deducted by your employer don’t often equal the taxes based on your annual It would be wise to have more taxes taken off your paycheque to avoid this issue in the future.
  • You receive several different sources of income with inadequate deductions, such as employment income, pension income, CPP and OAS. Or you may have cashed in an RRSP.  All of these sources of income are taxable.

What not to do

Don’t avoid it.  Don’t ignore it.  If you fail to file a tax return and owe taxes, Canada Revenue Agency (“CRA”) will  charge you a late filing penalty and interest on the balance owing. The penalty is 5% of the balance owing, plus 1% of your balance owing for each full month your return is late, to a maximum of 12 months.

If CRA charged a late-filing penalty on a prior income tax return, the late-filing penalty for 2016 may be 10% of your 2016 balance owing, plus 2% of your 2016 balance owing for each full month your return is late, to a maximum of 20 months.  That could possibly end up being a 50% penalty plus interest!  A tax debt can grow very fast once interest and penalties are added.

Knowing that you might have a large tax debt once you’ve filed can be stressful, but if you’re considering not filing to avoid it, this is the worst thing you can do. The debt is not going away, you're just delaying the inevitable

Even if you cannot pay your full balance owing on or before April 30, 2017, you can avoid the late-filing penalty by filing your return on time.

Liquidator of Strata Corporation Wind Ups

Recently, Strata Corporation Wind ups have become more frequent due to increased land values that have resulted in the bare land value of older strata corporations being more valuable than the aggregate market value of the Strata units.  

In other words, the bare land value is greater than each owner’s individual interest.  With virtually no available bare land for sale in the lower mainland, developers are now trying to acquire older strata developments for purposes of redevelopment.

In 2016, the Strata Property Act was amended to reduce the voting threshold to 80% that previously required unanimity of the strata owners to approve a winding up of a strata that is generally required to facilitate a sale to a developer.

The Strata Property Act requires the Strata Corporation, upon approving a winding up, to appoint a Liquidator to carry out the winding up.

What is a Licensed Insolvency Trustee?


A Licensed Insolvency Trustee is regulated by the Canadian government to process personal and corporate bankruptcies as well as administer proposals to creditors. A Licensed Insolvency Trustee is an officer of the court whose primary role is to ensure that your rights and your creditors’ rights are maintained throughout the process.

There are many companies who offer credit consulting or debt consolidation services. However, only a Licensed Insolvency Trustee can provide all these services as well as administer a consumer proposal or bankruptcy.

In Canada, Trustees are licensed and regulated by the federal government and will work with you to help determine what is the best option for you. Only Trustees abide by a strict code of conduct to explain all of your debt relief options while other debt consultants do not.

Latest BC Insolvency Statistics

Consumer insolvencies in BC increased overall in January 2017 by 9.3 percent from December, 2016.  Consumer proposals increased 14.1 percent while bankruptcies increased 3.7 percent.  

The proportion of proposals in consumer insolvencies in BC accounted for 56.5 percent during January while they account for 53.4 percent of all January 2017 insolvencies across Canada.

Consumer insolvencies in BC for the 12-month period ending January, 2017, decreased by 1.2 percent compared with the 12-month period ending January 2016. Consumer bankruptcies decreased by 10.2 percent, while consumer proposals increased by 7.1 percent.
