As Care Coordinators assist students in their transition back to school, it is important to understand how to collaborate and share information while maintaining the individual’s rights. There are two laws that are particularly relevant to this collaboration: HIPAA (Health Insurance Portability and Accountability Act of 1996), which protects health information, and FERPA (Family Educational Rights and Privacy Act), which governs students’ records held and maintained by “educational agencies or institutions.” HIPAA or FERPA? A Primer on Sharing School Health Information in Indiana clearly defines the two laws, explains when signed disclosure authorizations are necessary (assume they are), and delineates which law applies to which set of records.  In addition to familiarizing themselves with this information, Care Coordinators are encouraged to share or explain it to families to ensure they are fully aware of their rights to privacy.
