EREP Sites become “Scheduled Activity Premises”

  • As of 1 August 2017, former EREP sites are now called SAP (Scheduled Activity Premises)

  • These are excluded from the VEET scheme but can opt in, resulting in

    • Ability to create VEECs → for non-residential activities including Project Based Activities

    • Liability for energy retailer to pay under the VEET Scheme

How Does It Work? Required Order of Events

  1. SAP Site gives opt-in notice to the ESC

  2. VEET upgrade undertaken on site

  3. Certificates first registered

  4. On 1st Jan of 2nd year after calendar year of first certificate registration: site becomes “Prescribed Customer” → energy retailer liability begins

  5. From now on, energy retailer is likely to pass on the additional liability to the site
Further Things to Note
  • Former EREP site with multiple addresses → each becomes distinct SAP

    • E.g. University; each site can now decide individually to opt in

  • Former EREP site with multiple occupiers → subject to particular facts

    • E.g. shopping mall
