Plaintiff attorneys in the Alston & Jenkins cases have asked U.S. District Court Judge Wilken for a summary judgment based on "new and undisputed evidence" that, per USA Today's Berkowitz, "make it impossible for the NCAA to show that the limits are justifiable under antitrust law." Proposed solution: "...individual conferences and/or schools would be free to make their own independent determinations about how to fairly compensate." Depositions from the likes of NCAA Prez Emmert, NCAA EVP Luck, NCAA VP Lennon & Big 12 Commish Bowlsby are use by the plaintiffs to illustrate the situation as they say "amateurism is simply their version of a three-card Monte game in which the line defining amateurism never stays in the same place." The AD search at UT Chattanooga is down to four: Georgia Executive Assoc. AD Booz, Duke Senior Assoc. AD for Internal Affairs Harrison, Marshall Assoc. AD/Chief of Staff O'Malley & Penn State Assoc. Louisville's NCAA appeal comes into full light, calls the governing body's proposed penalties "unjust and grossly disproportionate." The university has asked for a reversal on some win & financial sanctions. One passage of note: "Furthermore, not one student who later competed in 2011-12 and 2012-13 seasons engaged in a sex act. Even if these student-athletes were technically ineligible, they would unquestionably have been reinstated. If nothing else, the IAC should reverse the COI’s decision to erase these two seasons of play in their entirety." Link includes full appeal. More legal news as U.S. District Court Judge Pitman says Baylor must release all its Pepper Hamilton records. Pitman: "Would it be fair to allow Baylor to protect remaining undisclosed details regarding the Pepper Hamilton investigation when it intentionally, publicly, and selectively released certain details of the investigation, including attorney-client communications? The Court concludes, with respect to materials covered by the attorney-client privilege, that it would not." Exceptions: Actual interview footage and/or notes produced from interviews. BU's response, in part, "Baylor continues to express concerns regarding the protection of students' personal records, specifically the desire of many students -- who are unrelated to this case -- that their identities remain anonymous and their information confidential." (link)
Deadspin's Moskovitz takes aim at the NCAA's new sexual violence policy, breaks down the tenants of the new stance in comparison to Cleary Act updates from a couple of years back. Thesis: The NCAA had already committed to the core of what it now calls new. Conclusion: "The NCAA promised to do all this three years ago. (“This,” again, being “compliance with laws and rules already in place.”) If it meant nothing then, it means nothing now." (link)
Ole Miss AD Bjork & SEC Network's Finebaum had what seems to be a tense back & forth on Thursday. Finebaum questioned how the Rebels could defend how former FB HC Freeze ran the program in light of NCAA penalties, yet released Freeze due to personal misconduct. Finebaum: "It sounds like you are suddenly saying you don’t have faith in Hugh Freeze and it just seems like this is a late switch in the game. I’m not arguing with you about semantics. I don’t know what you are going to say to that committee but you have certainly backed him to the hilt. I think that would be a fair statement." Bjork: "We have supported him along the way based on the facts of the case, based on how he ran the program, Paul. I don’t know what else to tell you." Former New Mexico AD Krebs in an email back in July to former Deputy AD & current Interim boss Ruggiero on issues in the Lobo Club, "I am thru taking undeserved hits. I had repeated conversations [...] multiple emails [...] concerted effort to collect on bad debt. Those guys need to own up to this and to be held accountable. This should not be laid at my feet and I am asking you two to see that UNM responds appropriately." (link)

In a June Harvard Business Review, freelance journalist and Wesleyan University lecturer Knight offers "7 Practical Ways to Reduce Bias in Your Hiring Process." 1. Seek to understand - get a grasp on what hiring prejudices are and have conversations about minimizing them; 2. Rework your job descriptions - certain adjectives, like "competitive" or "determined" can deter women, while "collaborative" and "cooperative" attract female applicants; 3. Go blind for the resume review - "The fact is Latisha and Jamal do not get the same number of callbacks as Emily and Greg. You need to look at what each person brings to the table;" 4. Give a work sample test - these are the best indicators of future job performance; 5. Standardize interviews - allows employers to "focus on the factors that have a direct impact on performance;" 6. Consider likeability (if it matters to you) - use a scorecard for each candidate to eliminate personal feelings; 7. Set diversity goals - diversity in the workforce results in "significant business advantages." (link)

This may give a couple of you an idea as the NHL will hold its first international media day given the portion of players who star for the league from Europe. Deputy Commish Daly: "We know the passion the fans in those countries have for the European-born players in the NHL, and we want to make sure we strengthen that connection as much as we can. We don't want our European fans to feel like once these players have left for the NHL that they have lost all connection to them outside of watching the games on television. An event like this reinforces that, and it also gives us a chance to work even more closely with our rights holders, who are so important in helping us grow the game." With a new $128M deal from Adidas worth $64M equally in cash and apparel, Nebraska now has the largest contract of any three stripes school. Per AD Eichorst, Nebraska did not receive offers from Nike, Under Armour, or others. (link);  Thanks in part to the new Adidas deal and increased Big Ten revenue, the Huskers' will provide $5M in scholarships for nonathletes, which, if divided into full scholarships would allow 500 students to attend school. Eichorst: "We've worked very hard and very strategically over the course of the last few years to build upon our great history and tradition and to strengthen our foundation for success -- particularly as it relates to our collaborations across the academic spectrum. It's been an important initiative for me from day one to ground and base everything we do in athletics in academics." (link)
A pair of Iowa swimmers launched their company, Trailheads Apparel, in February and although they left swimming references out of their products, the GoFundMe page set up for the company included the co-founders' names and bios, which mentioned that the pair met as swimmers at Iowa. This, of course, is an NCAA violation and the swimmers had to remove all references to themselves from anything associated with the company while they wait out an NCAA ruling on reinstating their eligibility. As Little Rock considers whether to restart its FB program, four firms have submitted bids to conduct the feasibility study: Collegiate Consulting, College Sports Solutions, Brailsford & Dunleavy, and Conventions, Sports & Leisure International. CSS worked on a similar study for Wichita State in 2016 for $60K, finding startup costs would be upwards of $40M and annual budgetary needs in the $6M range. Collegiate Consulting worked with Appalachian State in 2011 to explore the Mountaineers move to a FBS conference. CSLI helped Colorado State with plans for the on-campus FB stadium, set for first kick in a few weeks. Last month UALR Chancellor Rogerson estimated the study would take 6-7 months and come in under $100K. (link)
I always find these types of reads interesting, specifically because of their anonymous nature & trying to determine which comments are legit & which are veiled shots. Sports Illustrated's staff compiled comments from HCs of FB's preseason Top 25 on their peers. One comment on new Oklahoma HC Riley: "[He's] different from other Mike Leach guys." Someone on Louisville's Petrino: "[Coach Bobby] Petrino calls the plays and he’s good, but when adversity hits, he hurts that team. He’ll add to the problem because he’ll scream at the kids, and their heads will go down." Lots more. (link)

(link); ESPN's Scarborough predicts Alabama DC Pruitt "could emerge as a hot head-coaching candidate" and backs up his theory was a "Fruit of the Saban Tree" chart that includes 12 active head coaches who have worked under Tide FB HC Saban (link); Florida gave five FB ACs extensions and raises in the offseason: DL coach Rumph +3 years/+$100K up to $600K; OC Nussmeier +2 years/+$300K+ to $842,725; LB coach Skipper, WR coach Dixon and TE coach Nord all +2 with new deals worth $456K, $300K and $420K, respectively. When asked about LaVar Ball, Penn State FB HC Franklin on the matter: "I think [Ball is] kind of an outlier, even in basketball. That's kind of an extreme situation. ... I think that specific situation is pretty unique. I tell parents that you can come and talk to me 24 hours a day about social issues, about academics, about your son is not doing well because your girlfriend broke up with him. But don't call me about playing time." Former UCLA MBB standout and the eldest of LaVar Ball's sons, Lonzo: "It's pretty normal for me. He's been talking like this since I've been born, so it's nothing new for me. Y'all get to see it for the first time and he's always on TV. That's the only difference." Nevada AD Knuth was AthleticDirectorU's latest 'Athletic Director in Residence', answered subscriber-submitted questions on topics ranging from tips during coaching searches to the need for the all those in the business to effectively tell the positive stories of the student-athlete experience. Knuth: "If the positive message is ever going to stick, every one of us has to consistently share the message about the great examples of students earning college degrees as a result of their participation in sport. This is a powerful message and hard to ignore if we are all telling the positive impact story." (link); Knuth also talked up Wolf Pack supporters last week, does not think it's presently likely to add another sport, like Men's Soccer of Men's LAX. Indicates UNR's budget is the smallest in the Mountain West, so to further divvy the pot may not be the most effective decision, more. (link)
The court trial connected to the passing of a Penn State fraternity member & student has Asst. AD for Athletic Training Services Bream in the spotlight. Bream is also the resident advisor for Beta Theta Phi & was in the house on the night in question. Prosecuting attorneys want Bream on the stand & want him found in contempt of court if he refuses. Also, "a former state trooper testified to the numerous times he attempted to serve Bream with a subpoena to appear in court, noting that he reportedly spoke with an individual who identified himself as Bream on the phone who agreed to meet but never showed up." (link)
With two weeks left before first kick, ticket sales at USF are slightly down: 14,074 vs 15,973 last year, but there are 600 new season ticket holders. Part of the picture: non-conference games against Stony Brook, UMass and Illinois and three non-Saturday games which Deputy AD for External Kull calls "facts" not "excuses." (link); West Virginia is on pace for a fifth straight year of declining FB tix sales as 26,300 packages have been sold thus far. Mountaineers' fans seem to prefer the single-game or mini-package options, as attendance averaged 57,583 last season, compared to 28,035 in season ticket sales. (link)
When Southern Miss travels to Starkville in 2019, it will get $1.2M from Mississippi State, one of the larger purses for the Eagles in recent years. Future payouts include $1.7M and $1.85M for future tilts at Auburn in 2018 and 2020, respectively, and $1.85M for the 2019 game at Alabama, on top of the $1.4M the Eagles received for their trip to Tuscaloosa in 2014. The proposed policy that would allow alcohol sales pregame in Idaho has passed its first reading in front of the Idaho State Board of Education and faces a second reading in October in order to be finalized. Alcohol would be allowed in designated tailgating spots for ticketholders within FB stadium parking lots from 10 AM to 10 PM at Boise State, Idaho and Idaho State. The policy would also apply to basketball games for the Vandals and Broncos. In a trial run, Boise State sold alcohol at a pregame function during the 2015 season, but lost $15K on the event. AD Apsey expects to fare better in future endeavors. (link)
