C&G Founder appointed as Secretary of Junior Achievement of Southeastern Michigan Young Professionals Board
Junior Achievement (JA) is the nation's largest organization dedicated to giving young people the knowledge and skills they need to own their economic success, plan for their futures, and make smart academic and economic choices. JA’s programs—in the core content areas of work readiness, entrepreneurship and financial literacy—ignite the spark in young people to experience and realize the opportunities and realities of work and life in the 21st century.

Recently, Junior Achievement of Southeastern Michigan established a Young Professionals Board. The YP board is a group of innovative, energetic, and philanthropic young professionals with an interest in financial literacy, entrepreneurship, and work readiness. YP Board members are ambassadors for JA throughout the community and work to support the Organization’s mission. Board members fundraise, work with community leaders, as well as participate in and help plan events. Attorney Crump-Gibson has been appointed to serve as Board Secretary. What an awesome opportunity!
 
 Attorney Crump-Gibson to participate in Mentorjet Program                    

Attorney Crump-Gibson will be participating once again in the National Association of Women Judges (NAWJ) MentorJet program! MentorJet connects law students with leading lawyers and judges to learn about law practice and job opportunities.

This fall, the University of Michigan Law School will be hosting the event. During the course of the event, judges and lawyers will “mentor” law students in six minute “jet-like” blocks – think, speed mentoring. After each six-minute block, students will change seats thereby changing “mentors”, gathering information from those in practice. The event will take place on October 6th.
 



Attorney Crump-Gibson appointed to ICLE's Probate and Estate Planning Advisory Board


The Institute of Continuing Legal Education (ICLE) is a jointly sponsored Institute of the University of Michigan, cosponsored by the State Bar of Michigan and all of Michigan‘s major law schools. ICLE is the leading provider of how-to solutions that harness the wisdom of Michigan’s leading practitioners. ICLE has established advisory boards concentrating on a specific practice areas and distinct customer groups. Advisory Board members advise ICLE about the practical impact of new legal developments and review ICLE’s proposed courses, books, and technology projects to see if they match practitioners’ needs.

So: What's going on in the law?

 

Aging population + increase in Dementia sufferers = more families fighting in probate court!

     

We recently published a tip regarding testamentary capacity and the issues that can arise when it is challenged. For example, Anna, an 86-year old woman has been showing signs of Frontal Temporal Dementia for months now. She recently made out a Will, leaving everything to her son Edgar and leaving nothing to her daughters Lisa and Kathy. Edgar has been spending quite a bit more time with Anna in recent months- more than he ever has before. Did Anna have the testamentary capacity to make out a Will? Did Edgar place undue influence on his mother to change her Will? If his siblings are inclined to press the issues, it will be up to a court to determine!

We came across an interesting piece out of Wisconsin on there being increased opportunities for litigation involving estates, some like the example above. While the article brings several matters to the attention of estate planning attorneys, there are quite a few facts that are important for the general public to know!

According to the Article, in 1900, there were approximately 3 million people in the United States 65 years old or older- or around 4 percent of the population. In 2010, those amounts had increased to over 40 million (13 percent). Those amounts are projected to increase by 2050 to 88 million and over 20 percent. The average life expectancy of Americans at age 65 is now more than 19 years. What's more- in 2010 more than 5 million Americans had Alzheimer’s disease. It is projected that in 2050, more than 19 million will be afflicted. Do you see the concern?

Michigan House votes to subject governor and legislators to public records requests!

The Michigan House of Representatives has voted to subject the governor and lawmakers to public records requests. Michigan’s current Freedom of Information Act gives citizens the right of access to MOST public records and authorizes citizens to bring suit if wrongfully denied, to compel disclosure.

When the Act was written 40 years ago, the governor’s office was specifically exempted; a subsequent Attorney General opinion held that legislators intended to exempt themselves as well. Following the Flint Water Crisis and a sex scandal between two legislators, a 10-bill package to nullify these exceptions gained force. One of the measures would subject the governor, lieutenant governor, their offices and their employees to the Freedom of Information Act.

According to the Michigan Press Association, Michigan is one of just two states to completely exempt the governor from open records laws and among eight states where the legislature is specifically exempt. The bills have been sent to the Senate. We will keep you abreast of this all-important issue!
 

Michigan one of states suing Department of Labor to block expansion of overtime law

Officials from 21 states, including Michigan, have sued the Department of Labor over the new rule that would make roughly 4 million higher-earning workers eligible for overtime pay, citing it as “an inappropriate federal overreach by the Obama administration”. The suit was filed in Federal Court in Texas in efforts to stop the rule from taking effect December 1, 2016.

The new rule virtually doubles the salary threshold under which employers must pay overtime to their executive, administrative or professional staff. Overtime protections would apply to workers who make up to $913 a week, or $47,476 a year, and the threshold would readjust every three years to reflect changes in average wages. Of course, there are competing interests. There are business groups who believe the changes are burdensome- too drastic and too quick- while labor leadership believes that the new rule is long overdue.
