COCA Meets with Attorney General on Construction Lien Act Report

Following careful review of the Reynolds Report on modernizing the Construction Lien Act and prompt payment, COCA sent a letter to the Attorney General of Ontario recommending that the government:

  • Implement the report recommendations as a package
  • Retain Reynolds/Vogel as consultants through the legislative process to ensure that their vision is captured by the legislation
  • Continue to draw upon the expertise of the Advisory Group in the legislative process
  • Keep its commitment to table a bill in the spring and move it forward expeditiously
In a meeting with representatives from COCA on October 24th, Attorney General Yasir Naqvi made the following points:
  • The Advisory Group has confirmed the Reynolds/Vogel Report is a consensus report
  • From the stakeholders he has met with since the reports release, there is general support
  • Reynolds/Vogel have been engaged to continue providing advice through the legislative process
  • He is looking to continue to engage the Advisory Group
  • A legislative framework is being prepared for presentation to Cabinet to receive authority to proceed with the drafting of legislation
  • Legislation will be introduced in spring 2017
  • Ideally legislation would be passed before December 14, 2017
  • A transition period between the current Act and the new one will be required
  • A great deal of detail work must be completed in the next six weeks and COCA is invited to provide further input
