Tishkoff Attorneys Obtain Summary Disposition Dismissing Claims Against Client & Establishing Client’s Counterclaims In Business Dispute

Tishkoff PLC’s client, an in-home physical therapy provider, was in a contractual relationship with an in-home medical service provider, through which the medical service provider would refer patients to Tishkoff PLC’s client for treatment.  The medical service provider sued Tishkoff PLC’s client in Macomb County Circuit Court for, inter alia, alleged violation of a contractual exclusivity provision.  Tishkoff PLC’s client counter-sued for the medical service provider’s breach of contract and failure to compensate Tishkoff PLC’s client for services provided.  Tishkoff PLC successfully moved for summary disposition, resulting in the Court’s dismissal of all claims against Tishkoff PLC’s client and finding the medical service provider liable for Tishkoff PLC’s client’s counterclaim.

Default Judgments In Business Lawsuits

For large businesses in particular, it is easy for a new lawsuit to slip between the cracks or get lost in the paper shuffle.  Often times, if a defendant fails to respond to a lawsuit in time, the plaintiff will request entry of a default and default judgment against the defendant.  However, entry of a default is not necessarily the end of the line.  Under Michigan Court Rules, a default can be set aside if the defaulted party can show good cause for setting aside the default and that the party has a meritorious defense to the plaintiff’s claims.  MCR 2.603(D).

Time is critical and it is important to have a default set aside before a default judgment is entered, as the standard for setting aside a default judgment is harder to meet.  If your business was recently defaulted in a lawsuit, contact the attorneys at Tishkoff PLC today for a consultation.
