President's Message

The other day I was sitting outside the CAS Court Office on the 3rd floor of the Courthouse and looked at those around.  A criminal Court was in session.  The CAS matters were in a different Court.  The FRO docket was lengthy and there were many attending regular family court.
 
As I looked over the crowd assembled the expressions varied, reflecting looks of anguish, despair and apprehension….and that was just the lawyers!!
 
One of our local bar has been right to comment that “what we do is hard”.  It is true.  Clients come to our office with disparate problems and leave them on our desks.  They walk out the door with their burden lessened having left the weight on our shoulders.
 
At times it can become overwhelming.  It is important at times like these that counsel remember there is help for lawyers.  At recent FOLA (Federation of Ontario Law Associations) meetings, presentations have been  made by the Members Assistance Program office of the Law Society of Upper Canada.
 
A confidential service designed to help lawyers face a number of challenges, it is a free service offered to all members of the LSUC.  They went to great lengths to assure us and that the programs were confidential and that the information would not be relayed to the LSUC.  Sometimes just talking to someone can help us deal with issues.
 
Call for Nominations
 
I remind you that the York Region Law Association is looking for nominations to recognize a member or members who have made a lasting contribution to the Association and to the advancement of the practice of law in York Region.
 
It may be awarded to a lawyer who has:
 
  • been a member of the York Region Law Association for 10 years;
  • demonstrated a high level of excellence and achievement in the practice of law; and
  • has demonstrated a commitment to the advancement of the legal profession in York Region.
 
Any two members of the Association may nominate a member for the award which will be presented at the Annual General Meeting in April.
 
If you are aware of worthy members please put forward their names.
 
Real Estate
 
FOLA advises that problems have arisen with the registration of Notice of Leases on title and the organization has written the Director of Titles in this regard.  A link to a copy of their correspondence is included in the link below.

Registration of Leases on Title

There has been some recent debate between Ministry staff at the Land Registry Office and lawyers attempting to register a Notice of Lease. At the Six Minute Real Estate Lawyer program in November, the Director of Titles asked for input from the bar on this issue.
 
Please take a few minutes and review the attached summary of the issue set out in our letter to the Director of Titles and provide your feedback to the Ministry as well.

RECO CEO Advisory Group
 
RECO is setting up a CEO Advisory Group to provide it with observations and advice on emerging issues in the real estate sector.  RECO  would like to have a real estate lawyer participate in this group. Below is the link to the terms of reference of the Advisory Group.

Our Festive Tree of Knowledge

And since we are in the Festive Spirit....a Poem (or an attempt)


T’was the last week before Christmas, and all through the Library
The Staff were still busy, it was getting quite scary.
Fiscal year end was looming; money still to be spent
Invoices for copying and functions, in emails they went.
 
The lawyers were scrambling, CPDs to be completed
“But I only need 12 hours” was a phrase oft repeated.
Access cards to be printed, and reprinted if lost
Yes, you have to pay for the new one, they come at a cost.
 
With Betty back further and Janet out front
Finding files, lost phones and other things lawyers hunt;
Like pens and some paper and tabs and some gowns
Some cuff-links, some Advil; creating smiles from frowns.
 
Help with printing and scanning, faxes in and outbound;
Assisting with caselaw and research questions abound.
Other duties as required, or sometimes desperately needed
Including watching a toddler, while her mother pleaded. 
 
Resources for lawyers, both online and print
Anything that we’re missing, just give us a hint.
New computers for members and non-members as well
Compliments on these babies, they make our heads swell.
 
The lounge is the envy of all those who enter;
Complimentary coffee, it’s the best social centre!
A place to relax and to heat up your lunch
Or minutes of settlement when you’re in a crunch.
 
On top of the usual, by the way did we mention?
It’s the library’s turn now, to get some attention.
The reports are disposed of; the shelving is bare
In wait of some renos, to give it some flair.
 
The changes are needed to accommodate access
And hopefully worth it in spite of the big mess.
Some outlets and tables and more working spaces
Allowing more natural light, when researching your cases.
 
The work is being done over holidays and at night,
In hopes that the disturbance is ever so slight.
We’ll ring in the New Year in our bright airy space
The changes, we’re sure, you all will embrace.
 
"Now, Barbara! Now, Roselyn! Now, Constance and Feldstein!
On, Anders! On Lindsay! On, Donnell and Greenstein!
Away from the courtrooms, away from the cells!
Now dash away! Dash away! Bid your farewells!"
 
The staff are all tired and in need of some rest
But hope that your holidays will be the best
Better people, we could not have as employers
Don’t care what the rest say, cause we love our Lawyers!!!!
