Wellow Traffic Issues - Correspondence with B&NES iHghways (revised)

Dear All
I thought you might like to see the answers I have received to date to the various questions I posed a few weeks ago.
The PC are pursuing, with of course the valued support of your Community Speed Watch team.
Richard - feel free to edit and put on the website if you think it would be helpful for others, not on my list, to see.
HAPPY NEW YEAR!

Neil

PS: I have done my best to clean this up, without removing what might be useful secondary information about senders, for example.

"Dear Councillor Butters

I respond to your query 4;

4    Possible s106 Monies
Might there be a chance of obtaining s106 monies for traffic calming etc measure in Wellow as a result of the forthcoming housing developments at Peasedown and Sulis Down?

The legal tests for when you can use a s106 agreement are set out in regulation 122 and 123 of the Community Infrastructure Levy Regulations 2010 as amended.

The tests are:

  1.  necessary to make the development acceptable in planning terms
  2.  directly related to the development; and
  3.  fairly and reasonably related in scale and kind to the development.

There is opportunity to secure monies against any development in the area so long as they meet the above legal tests.  We would be looking for evidence of an issue such as the 85th percentile speed being in excess of the posted speed limit, issues around severance of the community, accident history for example.  Issues such as that you would expect to be ‘flushed’ out as part of their Transport Assessment for the development proposals.  I will forward your request to the Highway Development Control Officers so that they can secure monies when the opportunity arises.

Unfortunately I will need a little more time to establish if there are any existing monies that we could use, but will respond as soon as possible.

Regards, Claire.  [28 November.]

In response to the further questions raised at parish council, I have responded to point 3 already and can assist with point 2, HGV signage; I will investigate the situation regarding HGV’s and the unsuitable routes they are using, as you will be aware some of these routes will be used for deliveries but other will be drivers using SatNav to find their quickest route.

Point 1, Wellow Car park, I have forwarded this issue to George and Andy for one of them to make contact with Mr Holland.

Point 4, 106 contribution opportunities, I hope Claire will be able to advise me whether there is any currently funding available or future money coming.

I hope this will help.

Stefan

Subject: RE: Speeding on Exit from Wellow

Neil

I appreciate the concerns of the local residents and the difficulties they experience when accessing the local shop. What we can offer Wellow is a flashing speed sign on a temporary basis that also records the speed of vehicles. Following its stay in Wellow and with the data collected I'm happy to discuss the results with the local beat manager, should there be a large contravention of the existing 20mph speed limit and I would like to think that if necessary some enforcement could take place. Alternative, if the community think that there is an issue and feel strongly they should discuss with their beat manager the deployment of community speed watch which has been very successful in many wards and parishes in Bath & North East Somerset.  [Obviously there is already a CSW in Wellow, which does good work.]

Regards
Stefan

Subject: Wellow - Traffic Issues
Dear Louise

Several points if I may, following a meeting of Wellow PC on Monday night -

1   Wellow Car Park
I was pleased to see that in response to my question at Cabinet it has been agreed that an officer will come out to take a further look at the state of the car park.  Might I suggest that they liaise with Richard Holland, who lives nearby, and who I gather is a qualified civil engineering surveyor?  Richard has some useful ideas.  richard@cromwellow.myzen.co.uk<mailto:richard@cromwellow.myzen.co.uk>

2    Unsuitable for Heavy Lorries Signs
It seems that a number of heavy lorries have taken to using the roads between Odd Down/Hinton Charterhouse/Peasedown and Wellow, as through routes.  Local residents are concerned because of damage to trees by high vehicles, and because of danger to small children around the primary school (evidently the police had to be called recently due to traffic congestion there), and children and disabled adults around the Trekking Centre.  Could we please consider the use of the blue and white warning signs in the area, like the ones installed some time ago elsewhere in my ward at Freshford, etc?

3   'Smiley/Sad Face' Speed Sign
There are ongoing worries in Wellow about speeding through the village.  It seems that people are inclined to speed up - well beyond the official 20 mph limit - in particular near the shop (dangerous again because of children), in anticipation of the national speed limit length ahead.  What might be the chances of getting a speed deterrent sign - on a long or short term basis?

4    Possible s106 Monies
Might there be a chance of obtaining s106 monies for traffic calming etc measure in Wellow as a result of the forthcoming housing developments at Peasedown and Sulis Down?

Kind regards

Neil
