Time off in lieu of overtime update
Dear Sir/Madam

Do you have a time off in lieu policy or want to offer this to your employees?

You may recall that earlier this year we advised you of updates regarding a change to the time off in lieu provisions in a number of Modern Awards. Click here to read our last time off in lieu (TOIL) update. 

This update outlined a model clause inserted into a number of Awards that enables employers and employees to negotiate TOIL, rather than being paid for it. 

The Fair Work Commission (FWC) has now decided that an additional 23 Modern Awards will be amended in respect of TOIL.

These changes will take effect at the start of the first full pay period that starts on or after 14 December 2016. The FWC is yet to update the Modern Awards on their website to reflect these changes, so you may not be able to see them yet, but we want to ensure you are ahead of the game.

This change only affects employers who already offer employees TOIL or would like to do so. If this is you, please read on to understand the changes and how they affect you.

What do I need to do?
If your Employee Handbook contains a TOIL policy and your business or employees are covered by one of the Modern Awards listed above, please contact our Advice team on 1300 651 415 to discuss whether any changes need to be made to your policy or processes. If so, we will explain the changes required and prepare any agreements or documents.
