SIMPLIFYING CANNABIS AND THE ONTARIO WORKPLACE

On October 17, 2018, recreational cannabis use will become decriminalized in Canada.  This is causing a great deal of angst for employers, especially those with legitimate health and safety concerns.

However, there is no reason to panic!  Employers in Canada have been dealing with issues related to worker impairment (such as alcohol and other prescription medications) for decades.

The legalization of recreational marijuana is very similar to alcohol – employees will not have a right to be impaired or consume marijuana in the workplace.  Remember, the definition of ‘workplace’ for your organization may include company vehicles and/or customer sites.  Essentially, the legalization of recreational marijuana simply means that we can no longer treat cannabis as an illegal substance.

NCHR recommends implementing workplace policies that require employees to disclose any potential impairment or addiction that may interfere with them carrying out their normal duties, or otherwise pose a health and safety risk (especially if they work in safety sensitive positions).

This will provide your organization with the opportunity to assess the potential need to accommodate your employee, whether they are taking prescribed medical cannabis, have a dependence on alcohol, taking an over the counter cold medication that makes them groggy, or any other related issue.

So, with October 17, 2018 fast approaching, now is a good time to review your drug and alcohol policies.  Let us know if we can help.

ONTARIO EMPLOYERS ANTICIPATE MODERATE PAY INCREASES IN 2019

According to a recent (annual) survey by Morneau Shepell, where 356 Canadian organizations were queried about anticipated wage increases forthcoming for employees in 2019, Canadian salaries are expected to increase by an average 2.6%.

From the Provincial perspective, British Columbia (2.8%) and Alberta (2.7%) anticipate higher than average increases to employee salaries in 2019, whereas Ontario is expecting just less than average at 2.5% across the board.

The survey suggests higher increases in a broad range of industries including real estate, rental and leasing, finance and insurance, and manufacturing and retail trade.

Employers are encouraged to plan accordingly in order to ensure employee salaries remain competitive with the market.
