Alston Case: Law360's Atkins with some solid coverage of Day 3, one that saw Virginia economics professor Elzinga & University of Chicago's Heckman on the stand to defend their studies that show college athletics could see a drop off in popularity if student-athlete compensation is open to free market forces. Plaintiffs also showed comments from the MIT Sloan Sports Analytics Conference made by America East Commish Huchthausen on how added compensation wouldn't impact lower levels of DI competition. Notable from Atkins: "The student athletes' attorney just tried to ask Elzinga about the NCAA's use of students' name, image and likeness. The judge sustained an objection to the question. Judge: 'I don’t want to get into name, image and likeness. It’s a huge case and I don’t want to open the door.' […] Elzinga says the plaintiffs' experts ignored the short-term negative impacts and costs that removing the NCAA's pay caps would have on the schools and instead focuses on long-term benefits. But 'in the long-term we're all dead,' Elzinga said, quoting another famous economist. […] Elzinga on paying student athletes: 'That’s professionalism, but that’s not what we do...That’s are our product differentiation.'" ECU Chancellor Staton on an AD search in Greenville, "At the moment I can’t give you a definitive timeline, candidly, because we are still very much in evaluation mode. I’m not feeling any pressure whatsoever to be too rapid in that process or to move more quickly in that process because Dave is fulfilling that role as special advisor to the chancellor. The thing that I want people to understand is there’s nothing being left undone in relation to athletics in the situation that we’re currently in. I think all of us eventually want to move to having that decision made, but I’m not going to be rushed by that because there are still observations that need to be made and decisions that need to be made." Staton also indicated Assoc. AD for Internal Operations McLamb has taken on some additional responsibilities alongside acting COO Workman to ensure the department is running smoothly. (link); Whomever becomes the new boss for the Pirates will face a budget challenge that's set to be righted this year by a $4.223M transfer from the "Auxiliary/ITF (Institutional Trust Fund)." Acting COO Workman: "It’s a challenge we have in front of us, we all know it. 247 Sports' Ermann, who covers the Maryland beat, updates on what he's hearing about the investigations into Terps FB, "The more sources I talk to, more I'm convinced the ESPN story alleging a 'toxic culture' in #Terps football program was largely exaggeration/ anecdotes framed to suit a predetermined narrative. I'm not alone. Going to get interesting. […] No one, obviously, is giving UMD a pass for Jordan McNair's death. The biggest question-- how/if Durkin was involved in his treatment/overexertion that day, if he influenced trainers-- hasn't been answered. If so, I it seems a 100% consensus he should be fired w/ cause. […] If the investigation into the alleged toxic culture comes up empty, it will be up to Maryland to decide who was at fault on that tragic day and whether Durkin's leadership played a role in Jordan McNair's failed treatment/death. TCU AD Donati reviews his first nine months leading the Horned Frogs, believes he has the best collection of FB, MBB & Baseball HCs in the nation, "Our secret sauce, if you will, has been hiring and retaining coaches." Texas AD & former TCU boss Del Conte continues to say Donati will excel in his new role & the same comes from notable sports agent Steinberg, for whom Donati worked before getting into college athletics. Donati on the media rights landscape: "This AT&T/Time Warner merger, I’ve got my eyes on that. If that does go through, that paves the way for potentially a lot of other big multimedia deals that could be significant players going forward. I don’t think ESPN is going anywhere. I don’t think FOX is going anywhere. But can you imagine if there was another huge ... who is to say AT&T couldn’t be a player? So we’ll just kind of see in the next few years." More. (link)
Iowa AD Barta would like to see all 'Power 5' FB programs play 10 league games, "It’s a little clunky when you have to go five (conference home games) one year, four the next year. I’d prefer all conferences went to 10 conference games instead. I think it’d be exciting. I think it’s good for the fans to have more conference games." On FB scheduling, Barta says most deals out into the future are still pretty predictable in terms of the level of play an opponent will bring, continues to be committed to the Iowa State rivalry. On declining his $50K raise, "I was asking the rest of our department to freeze salaries, so in good faith, I didn’t feel comfortable." (link)

That's Michigan State AD Beekman discussing how the Spartans avoided NCAA penalties in the Nassar saga. More: "All we wanted to explain to the NCAA, frankly, was that, just, look at the facts. I think if you look at the facts you’ll see that our folks followed the rules — that when a student-athlete walked into Mark Dantonio’s office and wanted to talk about a sexual assault, Mark Dantonio stopped the conversation and immediately reported it to the police, to the Office of Institutional Equity and did exactly — exactly — what he was supposed to do. Tom Izzo, in each and every case, did exactly what he was supposed to do." Notable attorney Brown: "...the NCAA learned in the Penn State case that it needs to stick to the specific operating bylaws and not try to build an NCAA infractions case on general concepts or theories, regardless of how appropriate or noble those theories may be." Two Florida International FB student-athletes were shot in a drive by shooting yesterday in Opa-Locka. Neither sustained life-threatening injuries & Panthers HC Davis comments, "When you hear the news that we received today your heart drops. We've been receiving encouraging reports on their conditions and our thoughts and prayers are with the families of Anthony Jones and Mershawn Miller during this time." Jones ran for two touchdowns against Indiana last week, was reportedly shot in the face & back. (link)
Wendy's College Tailgating Tour sets off on its second annual journey this weekend with a stop in Gainesville for the Florida-Kentucky kick. Coca-Cola Freestyle, Pringles, Cheez-It & Texas Pete are all along for the ride this year. Execution will be handled by IMG Live. Looks like the tour will go as far west as the Rose Bowl, as far east as Morgantown, as far north as Pullman & as far south as Gainesville. Utah Men's LAX will play its first season as an NCAA program next year & will log an astounding 23,129 miles in the process of completing its 2019 schedule. The longest is a 4,500-plus mile roundtrip to Hartford & back, but there's also not-quite-around-the-corner trips to and/or from Salt Lake City to Furman, Hofstra, Duke & Virginia. "To put that into context, the distance from Jupiter, Florida to Ocean Creek, Washington is 2,802 miles. Based on their travels this year, the team would be making this trip over eight times, including four round-trips." (link)

A shocker in the Baseball world as longtime & highly successful Oregon State HC Casey, who won his third National Championship back in June, decides to retire. Casey will stick with the Beavs as Special Assistant to the VP & AD, as AC Bailey will serve as Interim HC. OSU AD Barnes: "It’s very difficult to put into words what Coach Casey has done for Oregon State University, the state of Oregon, college baseball overall and the tremendous impact he has made on the lives of so many young people during his coaching career." Casey: "I have always expected that I be at the same level at which we ask our players day in and day out, and right now, I’m not sure I can’t do that, but I’m also not certain I can. Therefore, I believe it is the right time to step down as head coach of the Oregon State baseball program." (link)
Seven hours northeast of Corvallis, Gonzaga AD Roth understands the process of replacing an exemplary HC, as he did when former WBB boss Graves moved on to Oregon back in 2014. Roth ended up hiring Bulldogs AC Fortier, who has since reeled off 99 wins in 4 seasons. Fortier is yet another example of Roth staying in house for HC hires. Roth: "I’m not looking for the best coach, I’m looking for the best person, I’m looking for the best person to fit Gonzaga University. Once we find that person, they are also going to be the best coach. But first, they have to be the best person. […] We are never trying to groom somebody to take over here or we are never trying to groom someone to be a head coach somewhere else. That is not our mindset, but that’s the outcome. […] Hiring is the hardest thing you do as an administrator. We’ve been, knock on wood, relatively successful over the years with hiring, but we’ve not been perfect." (link)
Three Kentucky Men's Soccer student-athletes & one Women's Soccer student-athlete dinged for playing a pick-up game with high-profile band the Foo Fighters and several coaches back in May & will have to sit out two team activities. Why? "The pick-up game took place the week before final exams, when the NCAA prohibits coaches from being involved with players in an event like a pick-up game." (link); Former San Jose State Baseball HC Hawkins failed to promote an atmosphere of compliance during his tenure with the Spartans connected to voluntary workouts before & after mandatory practices that were reported on daily practice schedules. In many cases the student-athletes believed the workouts were mandatory. Handful of penalties includes two years of probation, one year of a show cause for Hawkins, a $5K fine & more. (link)
Alabama FB HC Saban with an interesting thought for Crimson Tide fans, "You want our players to compete for 60 minutes in a game, but the fans don't stay there for 60 minutes in a game. I can never figure that out. YOU WANT TO BE A PART OF THE TEAM, THEN DO WHAT EVERYBODY ELSE DOES — STAY THERE & COMPETE FOR 60 MINUTES!!" The very first comment in the Twitter thread is equally interesting & a microcosm of where scheduling is going for Bama & others, "Stop scheduling these crap home games." (link)

The Reno Aces, the Triple-A affiliate of the Arizona Diamondbacks, as well as Reno 1868 FC, a United Soccer League squad, are experimenting with allowing employees to work five-hour days. Both organizations are overseen by Prez Edelstein, "Although, it’s really not about time at all, and more about developing an attitude of working more efficiently. […] The idea was to see what would happen if we empowered our staff members to have a tangible benefit of getting stuff done faster." Edelstein says there has been an overall productivity increase during the experiment, however, "There will still be hard work, lots of work, and something like fatigue on game-day is unavoidable, really." Idaho: Outgoing Prez Staben says athletics is projected to end the current fiscal year at a $750K deficit. Staben has tasked Interim AD Isakson & VP for Finance Foisy to develop a longterm plan to get the Vandals back on balance. Looks like former AD Spear's pay of $181K annually through February of 2020 does include mitigation. (link); Isakson says he'd "be interested in that scenario," of becoming the permanent AD. Points to ticket sales being up by 15% as the Vandals start to get comfortable at the FCS level, wants to take good care of the department until a new boss is hired next year. Outgoing Savannah State AD Steward, who was recently named to the same role at Alaska Fairbanks, discusses his decision to leave with the Tigers' student paper. On his time at SSU: "In seven years it felt like 70 years because we had so many challenges, trials and tribulations that we managed to overcome." Asked if SSU would ever return to Division I status: "I think they can but it needs to be a focus and concentration effort on everyone, not just the athletic director. We have to change the culture and mindset of everyone. This was something that had to be done but could have been avoided. If everyone had the mindset of giving simply by purchasing a season pass and supporting the athletes we can become D1 again. But everyone has to get involved." Also, says he turned down previous job offers to "fulfill obligations and aspirations" with the Tigers. Asst. AD for Media Relations/Licensing Coordinator Marshariki will serve as Interim AD. (link)
From a 32-page report released yesterday by the New Mexico AG's office: "Since 2015, UNM has established a pattern and practice of neglecting their responsibility to allow access to public information and access to meaningful discourse and deliberation on public business." Lots in there about former AD Krebs' golfing trip to Scotland in 2015 and internal correspondence between Krebs and others in which he orders the deletion of texts and emails. AG spokesman Carl: "UNM needs to do some soul searching. The lack of transparency has negatively impacted its financial operations and continues to be a black eye for students and our community." (link); Current Lobos AD Nunez already planned to ask the state legislature for $2.6M and has now upped that by an additional $1.5M for "Title IX compliance and increases in rising student costs, which include the cost of attendance, new equipment, and travel expenses." Facilities: Tulane has a new 14,811 square-foot dining facility in Yulman Stadium called the Green Wave Grille. Includes a full kitchen, dining areas and prep space and is available to the entire university community but focuses on meeting the "nutritional needs" of student-athletes.
