Day 9 of the Alston case. Notable from Law360's Atkins: "Wilkinson points to a study that tested whether 87 consumer surveys accurately predicted real world behaviors. Poret admits that the results were broad, but all showed positive correlations, meaning 'all found some useful predictive value to consumer behavior.' […] The student athletes' attorney points to a survey done by an @NCAA expert in the O'Bannon case. NCAA's counsel objects to the line of q's. The student athletes argue that Poret's methodology is the similar to the NCAA expert's method, so the NCAA can't now challenge its validity. The @NCAA's counsel has raised multiple objections on a number of grounds to Poret's testimony about surveys and testimony he gave in the O'Bannon case. The judge has overruled all of the objections. […] Judge Wilken says she's concerned that the parties might need to call @UWMadison's Rebecca Blank back to testify on whether she authorized a press statement the school issued in response to her testimony last week. […] @NCAA counsel vigorously opposed calling Blank back to the stand, arguing it's a waste of time. The student athletes said they would use their time to call her back tmr. (Both sides have only 22.5 hrs each to argue and the trial must end tmr based on the judge's rules.) […] Kessler notes that in the Autnomy FBS conferences, football revenues doubled between 2004 and 2016, while the median value for head coaches' salaries more than tripled, from $1M to $3.529M. […] We're back. (NCAA expert witness) Isaacson is on the stand. The student athletes' attorney says Isaacson never asked survey participants about their future behavior and instead only asked about their preferences. Isaacson says the answers are still relevant to predicting future behavior. […] Kessler is drilling Isaacson on his choice to use the 'disjunctive" phrase and/or' in the question and his choice not to clarify what an amateur is and how much student athletes receive in cost-of-attendance scholarships." Further, Wilken wants a declaration from Blank, will allow student-athletes economics expert Noll to respond to some criticisms, "is still confused by how Pell Grants can be more than cost-of-attendance and she wants to know how federal government guides cost-of-attendance. 'What are those regulations? What do they say?', also, per Atkins, "The judge wants to know if there's an analysis of how many student athletes get scholarships and how much they get." (link); San Francisco Daily Journal's Cho was also in court yesterday. Prospective jurors in the MBB-FBI court case that starts October 1 & includes former Adidas employees Gatto & Code, as well as agency runner Dawkins, will be asked a series of 14 questions to determine their fit as part of the jury. There's a number of inquires on impartiality toward the NCAA, if student-athletes should be further compensated & if the possible juror was a former student-athlete. Also, "Do you closely follow any college sports? If so, which sports and which colleges/teams do you follow?" And, "...the Government alleges in this case that the universities that were victims of the crimes that are charged in the Indictment were the University of Louisville, the University of Miami, North Carolina State University, and the University of Kansas. Do you or any other member of your household have any affiliation or connection to any of those universities? If so, is there anything about that affiliation or connection that would make it difficult for you to be fair and impartial in this case?" More. (link)
LEAD1 rolls-out survey results of its constituents: 62% are in favor of an integrity fee tied to legalized sports gambling, 52% would like to see a uniform injury reporting structure, 20% would accept money from a gaming interest, 50% are thinking about creating a varsity esports program in the next five years, 71% believe esports will be a big thing in the foreseeable future, 43% think student affairs should oversee esports, 33% point to the athletic department & 21% to academic units. More: 42% already distribute content via OTT platforms & LEAD1 institutions produce an average of 250 hours of live content & 200 hours of non-live per year. (link)
Pac-12 Commish Scott's latest thoughts on #AfterDark FB kickoffs, "The reason we play almost a third of our games at night is that was a way to unlock significant value from television in our last negations. ESPN and Fox placed a high value on us giving them a little more flexibility and being willing to play more night games. The Pac-12 is the only Power 5 conference with schools in the Pacific time zone. Late starts are a way to avoid competition for eyeballs with the SEC, ACC, Big Ten and Big 12. […] We essentially extend their day. We give them a whole other window of high-quality, highly rated games. ... Playing more night games than we did in the past unlocked the kind of value our schools were looking for." On the Pac-12 Networks: "We're creating a lot of value for the members. I would describe it as stable, valuable but probably not growing at the moment." Legalized sports gambling: "I think there's still a lot of water to go under the bridge in terms of whether there might be some federal legislation and rules around it, or whether it will be truly state by state." Utah State AD Hartwell contributes to AthleticDirectorU with a look inside his leadership handbook. In challenging student-athlete or personnel situations, Hartwell poses the questions: 1) Have I been honest?; 2) Have I been consistent; 3) Have I done what's best for Utah State University?; and, 4) Have I communicated the decision process to the necessary parties? "If you can answer 'Yes' to all of these questions, you know you have done the right thing." Hartwell notes part of his preparation process includes an old-school "To Do List" & notes a key skill ADs have to learn, "You must be able to overcome unplanned time consuming events during any given day to ensure that the must do items get done." UTSA AD Campos points to the majority Hispanic enrollment on campus as part of the university's vision that "really aligns with who I am." What role should the Roadrunners play for the overall student body? "I imagine this athletics department being the fabric of the undergraduate experience. Athletics can be such a great partner for the rest of the institution because it provides so many of the memorable out-of-classroom experiences that people think of when they reflect on their time in college." One initiative Campos is clearly focused on is upgrading the facilities portfolio, "There have been a lot of different conversations about partnerships—whether it’s with the city, the school districts, or private partnerships—to build a new facility. The changes continue at Northeastern as AD Konya introduces the new 'Howlin' Huskies Fund' that will center on generating unrestricted funds for reinvestment. Konya: "This new athletics annual fund is our way to provide a fully integrated program of support to enhance the opportunities of our student-athletes to continue our ascent toward national competitive achievement. […] We have articulated our collective aspirations in the Athletics 2025 Vision, which includes providing a distinctive student-athlete experience, creating a culture of excellence, unleashing opportunities to engage with internal and external stakeholders, and developing platforms for success through effective and creative operational efficiency." (link)
As part of his latest media column, The Athletic's Deitsch catches up with SEC on CBS play-by-play lead Nessler on some inside baseball of his job. Says he "couldn't be more comfortable" in his second year after taking over for the venerable voice of Vern Lundquist, indicates the biggest difference in calling college vs. pro games is the size of the rosters you have to know on the collegiate side, interestingly points to Alabama HC Saban as the most forthcoming about information out of all HCs with which the crew sits down. The state of New Mexico settled with a woman who alleged the University of New Mexico mishandled her rape case that involved two former FB student-athletes. Settlement amount: $200K. No word on how much the university paid out. Settlement docs were signed in 2016. The two former FB student-athletes were never prosecuted. (link)
More Personnel: Ohio State FB HC Meyer says he "hasn't given any thought" to reports of former interim HC Day being named as coach-in-waiting for the Buckeyes. (link); Colorado State AD Parker stands by FB HC Bobo: "I don’t think we’re at a moment where we should be questioning the long-term commitment to Coach Bobo and the direction that he’s leading his program." (link); Totally missed this last week, but big name attorney Wilkinson, who is representing the NCAA in the Alston case, was hired by Supreme Court nominee Kavanaugh to aid his push. (link); William & Mary AD Huge tabs former Tribe student-athlete and AC Bickford as the next Women's Tennis HC in Williamsburg. Bickford is currently the AHC at Old Dominion. (link); Former Maine MBB HC Walsh named technical director of basketball at IMG Academy. (link); Instagram co-founders Systrom and Krieger have resigned from Facebook and will leave the company in the coming weeks. Systrom indicates he and Krieger are "ready for our next chapter." Few MBB HCs have been as successful as Virginia boss Bennett over the last couple of seasons & here are the five non-hoops traits he looks for in prospective student-athletes: 1) Carefree courageousness ("I like guys who play with courage, yet they're free."); 2) Competitiveness; 3) Composure ("Drive, but also can let things go."); 4) Confidence ("Sometimes guys just don’t know any better – they just kind of go out and do it and are like, ‘Wow, how’d that happen!"); and, 5) Character. When news broke of the FBI-MBB investigation, then-University of Louisville Foundation board member Tyra was "surprised like everyone else. I wasn't like out of my mind upset, more disappointed and sad. It felt like we'd been through enough and this was more to endure. I probably felt the same as most because I'm a fan and a donor." A year later, now in the AD seat, Tyra is optimistic about the Cards future: "I think donors are getting their head around where we’re going. Not many of them really ask a lot of questions about the FBI or NCAA. That kind of passed. ... Recruits do, because other competing schools probably bring it up, and I address it head-on with parents. But more importantly, it's about how we're going to take care of their son or daughter while they're here and why this is a terrific place for them. ... Our culture of running a clean athletic department and a clean business, it starts with me. The moral compass is up, and it should have been a long time ago." (link)
High Point breaks ground on the Nido and Mariana Qubein Arena, Conference Center and Hotel, which will be ready in 2020. The $120M facility will serve as home for MBB and WBB, major events, academic conferences, a learning lab for HPU's event management minor and a proposed hospitality program. The arena portion will have seats for 4,500, including luxury suites, locker rooms, staff offices, concessions and merchandising, ticket office, practice gym, weight room, athletic training room and more. Conference center will accommodate 2,500 and can be sectioned off for smaller settings. (link)
Last week, San Diego State issued a letter to the Measure E stadium campaign insisting that FS Investors stop circulating information the school says is confusing to students and voters in ads appearing on SoccerCity TV and social media. Additionally, SDSU requested that SoccerCity add a disclaimer to ads to clarify that the university does not support the ballot measure, which will be voted upon Nov. 6. SDSU CFO McCarron: "We are compelled to send this letter asking SoccerCity, its affiliates and sponsors to refrain from making inaccurate or misleading statements as they relate to SDSU and the university’s proposed plan to redevelop the Mission Valley stadium site. The SoccerCitySD.com website and other political advertisements make a number of factually questionable statements about the university, none of which has been substantiated by SDSU or its leadership." Both sides are vying for redevelopment of the Mission Valley site with a stadium, housing, commercial projects and a public park. School officials argue against claims that student fees or taxpayer funds will pay for the plans, insisting instead that revenue bonds, public-private partnerships and philanthropic gifts will cover the balance. Facilities, continued: North Carolina will name its new field hockey stadium after 38-year HC Shelton. A lead gift from Ken and Cheryl Williams made the naming possible for Shelton Stadium, a 900-chairback seat venue that features a three-level press box, video board and FIH-certified turf field. (link); Ohio State will build a new $21.9M  indoor tennis complex, known as the Ty Tucker Tennis Center and funded by "development funds and university debt." Construction of the 75K square-foot facility begins a year from now, with a target completion date of December 2021. It will include six indoor courts, seating for 450, men's and women's team locker rooms and training facilities. (link); Populous expands with a new office in Dallas, led by designers Chambers and Kelley with a focus on "a wide range of project types and services including sports and entertainment venues, convention centers, aviation experience architecture, hospitality architecture and interior design." Populous Americas Managing Director and Senior Principal Santee: "Having  a  physical  presence  in  the Texas  market  has  been  on  our  radar  for  many  years;  it  is  indicative  of  our  desire  to  continually  adapt  to  changing  market needs." LSU Prez Alexander talks FB & a 4-0 start for the Tigers, "Nobody gave us the time of day going into the season. This team feels like it has something to prove and it's proving it. ... That's [No. 25] the lowest we've been ranked to begin the season since I've been here and we have the toughest scheduled in the country. ... Coach O is doing a great job. We're thrilled."
