Looking Forward to 2018

As we wrap up 2017, it’s not too soon to start thinking about employment-related initiatives for 2018 to ensure compliance with what has been another whirlwind year of legislative changes.  Key priorities for the coming quarter include:

Review/Update Employee Handbook.  Particularly at the state level, there were a number of legal issues in 2017 that may impact handbooks, including gender identity discrimination, expanded pregnancy rights, equal pay, medical/family leave, background checks, minimum wage changes, and marijuana use.

Even where laws might not have specifically changed, interpretation of existing legislation by both courts and government agencies has evolved in some areas, including confidentiality, non-competes, social media, recording in the workplace, and workplace injury programs.

Harassment Training.  Courts and the EEOC consistently rule that a well-written policy against harassment that is frequently communicated, coupled with periodic employee training is a minimum requirement for employers to even begin to defend themselves against a harassment complaint.  Some states, including California, Connecticut, and Maine, actually mandate training.  Most recently, the EEOC determined that to be effective, training must be interactive and meaningful to employees and be part of an ongoing, holistic approach to preventing harassment.

Audit I-9 Forms.  In 2017, the federal government published yet another revised I-9 form, so it is critical to ensure you are using the most recent version for new hires.  Additionally, based on the hire dates of past hires, you may have a number of versions in circulation.  Now is the perfect time to audit each form of employees to ensure they are completed fully and accurately.  I-9 errors are usually easy to correct but are very costly to leave unchecked.
