Good morning,

I hope you have been enjoying a peaceful Easter with your family!
 
The DIGITALEUROPE family is growing and we are happy to announce BOSCH as a new member! BOSCH will bring a wide range of expertise and experience as a European company that is heavily engaged in the digital transformation of industries. In particular, our national trade associations and corporate members are looking forward to hearing more on their perspectives for cutting edge areas such as artificial intelligence, IoT and manufacturing 4.0.
 
When it comes to policy, we have been working very closely with our policy groups to advocate on several important issues over the past few weeks. IMCO has received the amendments for Free Flow of Data Regulation which remains on the right track though there is still more alignment needed on mixed data sets. We continue to be concerned on the duplication of the ePrivacy regulation with the GDPR, as well as the hasty and imbalanced discussions on the Copyright Directive. We are however pleased to see that legislators are starting to realise that the lack of a broad Text-and-Data Mining exemption would severely hamper European R&D for important areas such Artificial Intelligence.
 
Talking about R&D and R&I, we have been active in advocating for more targeted EU investments in digital technologies and for more focus on public-private collaboration. We hosted and facilitated a fruitful discussion on the future of EU research in the context of the upcoming FP9 and MFF priorities. DIGITALEUROPE has also prepared a call for actions and recommendations for the MFF which we will share with Presidents Juncker, Tajani and Tusk in the next few days.
 
On sustainability, DIGITALEUROPE continues to advocate for as much alignment as possible with the EU RoHS Directive as, over the past few years, an increasing number of non-EU jurisdictions have copied the EU RoHS Directive as a model of legislation restricting hazardous substances.
 
On taxation, the Commission’s proposal singles out digital activities - targeting related revenues instead of profits - and sets out to establish a taxable nexus for digital business operating cross border, thus overlooking key principles such as no double taxation or permanent establishment. I reacted to the Commission’s proposal in the ARTE TV Journal to recall the importance of a global approach and of ensuring investments and innovation can still happen in Europe. Next steps will be critical to the future of the proposal and we are working closely with our national trade associations in making sure that the ongoing international approach will stay the course.    
 
On a more positive note, we see good results from the National Coalitions for Digital Skills and Jobs which aim at tackling the lack of digital skill across Europe. We see that National Coalitions in 18 countries have created strong ecosystems of digital stakeholders from the private and public sectors, NGOs and social partners. Working together, they contribute to improve European citizens' digital skills. Many of them advise their governments on how to roll out national programmes for digital skills. Under the Digital Skills and Jobs Coalition, DIGITALEUROPE is currently visiting National Coalitions in FranceHungary, Latvia, Lithuania, Slovakia to collect best practices, guide them and inspire others. 
 
Finally, I also encourage you to review our position paper on the upcoming fairness in platform-to-business regulation. We believe that our guidance offers a balanced view on how the industry and all political stakeholders can work together on a regulation that supports the innovation and economic growth that thousands of platforms are bringing to the EU.
 
It is in this spirit of greater collaboration that I will be visiting our Japanese and South Korean Members in Tokyo and Seoul later this month, whom I wish to thank for their invaluable support in planning and hosting my visits and meetings, and that I invite you to read today’s newsletter!

On 23 March, we organised a Digital in Practice Programme  (DiPP) workshop on the future of healthcare. With all the opportunities offered by digital technologies,  we discussed issues such as how to collectively agree for a better balance between individual and common interest in healthcare.

On 27 March 2018, DIGITALEUROPE’s trade vice-chair and lead for export control, Magnus Nordéus from Ericsson, presented the IT industry’s expectations and concerns towards the modernisation of the EU export control regime during a conference organised by Politico and hosted by DIGITALEUROPE’s member Microsoft.

The European Internet Forum elects its new board and discussed EU's Cybersecurity challenges
On 20 March, Cecilia Bonefeld-Dahl, DIGITALEUROPE's Director General, was elected Member of the Management Board of the European Internet Forum. The EIF General Assembly was followed by a debate on EU's Cybersecurity challenges, with MEP Angelika Niebler (EP rapporteur on the file). The focus of the discussions was on the need to improve the cybersecurity and resilience in the Union, the role of ENISA in doing this, and the key aspects of the legislative file at hand, the Cybersecurity Act, which would mandate whether and how the EU cybersecurity certification framework will contribute in raising citizens' trust while providing competitive advantage to businesses with security in mind. DIGITALEUROPE participates in cybersecurity debate at the European Parliament
On 22 March, DIGITALEUROPE's Iva Tasheva participated in a breakfast debate on Cybersecurity in a Single Market, hosted by Eva Kaili MEP in cooperation with ENISA. Amongst the keynote speakers were Mariya Gabriel, European Commissioner for Digital Economy and Society, and Despina Spanou, Director for Digital Society, Trust and Cybersecurity within DG Connect, Prof. Dr. Udo Helmbrecht, Executive Director of ENISA. The key topic of the debate between policy makers, industry and stakeholders was the Cybersecurity Act, including the need to strengthen the capacity of ENISA and the cybersecurity certification framework proposal. Other topics debated included the Internet of Things, and the ongoing development of 'supercomputers' and quantum computing. See tweet
Second meeting of the GDPR multistakeholder expert group
On 20 March, DIGITALEUROPE’s lead for Infrastructure, Privacy and Security, Alberto Di Felice, took part in the second meeting of the European Commission’s multistakeholder expert group to support the application of the GDPR. The group, gathering select experts from academia, NGOs and business associations, met to discuss activities to raise awareness among the public as to the new data protection law and to assess criteria for the possible introduction of pan-EU Codes of Conduct or certification mechanisms.
Helping non-profits to be ready for the GDPR
On 16 March, DIGITALEUROPE's Alberto Di Felice, participated in GDPRTODAY, the first of a series of training workshops specifically designed for non-for-profit organisations. As the GDPR’s 25 May date of application approaches, non-profits such as associations and charities can find it particularly difficult to cope with the law’s complex new requirements. Alberto trained participants on the issue of data transfers to non-EU countries.

German Marshall Fund conference with 42 National Members of Parliament in Paris
On the weekend between 2-4 March, DIGITALEUROPE Policy Director Ray Pinto engaged in a panel discussion with Martin Bailey, Head of Unit for the Digital Policy Coordination and Development, DG CONNECT, on how national governments should be thinking about technology. Read more
Guidance on fairness and transparency for business users of online platforms
In Europe, online platforms play a particularly important role as they facilitate cross-border transactions bridging geographic and language divides that would otherwise constitute major hurdles for European consumers as well as for small and medium-sized businesses, the backbone of the European economy. In fact, platforms have stepped in where regulation has failed to support businesses cross-border and thus constitute a key element in achieving a truly Digital Single Market. See DIGITALEUROPE guidance
