Library User in the Spotlight: Kosuke Onishi

I have been frequenting the Peace Palace Library since last September and yet I still find myself straining my neck to look up at the structure of the Peace Palace every time. The building reminds me of the significance of everything that I am learning about and puts me in the proper mindset to conduct research. Its willingness to expand its jurisdiction and defend vulnerable groups against powerful states has shown it to be a bold court with a desire to vigorously uphold its mandate to protect human rights on the Continent. Whilst it indeed seems that the Court has the aspiration to assert itself, the fact that so few states have deposited their Special Declarations allowing individuals and NGOs direct access to the Court continues to hamper its effectiveness. The Court’s outreach efforts to engage with states and civil society in response to this paucity of Special Declarations do appear to be having some success, however, progress has been slow and the Court may have to have recourse to other means to improve state engagement in future.

Foreign Direct Investment

Foreign Direct Investment - Research Guide International LawForeign Direct Investment (FDI) is a category of investment that reflects the objective of establishing a lasting interest by a resident enterprise in one economy in an enterprise that is resident in an economy other than that of the direct investor. The ICSID Convention is a multilateral treaty formulated by the Executive Directors of the International Bank for Reconstruction and Development (the World Bank). Although ICSID is considered to be the leading international arbitration institution devoted to investor-State arbitration, the Transatlantic Trade and Investment Partnership (TTIP) agreement between the European Union and the United States included an investor-state dispute settlement (ISDS) mechanism, whereby individual foreign investors may bring claims against host state governments for breach of the TTIP’s investment protection standards.
