Spencer Fane's Lattinville & Denny pen on the Intermediate Sanctions Tax & its potential impact directly on Athletics Directors. The pair thoroughly review the definition of an excess benefit transaction, the first contract exemption rule, applicable tax-exempt organizations, disqualified persons, consequences & "creating a rebuttal presumption." Key passages: "While the most recent excise tax certainly warrants the attention it is receiving, it’s important to recognize that it is imposed on the tax-exempt employer (e.g., colleges and universities). Conversely, the intermediate sanctions tax was enacted more than two decades ago and imposes an additional tax directly on employees (e.g., athletics directors and potentially coaches) of tax-exempt organizations. […] Since the 2010 interim report, the average compensation for head football coaches in the Autonomy Five conferences has increased by 74.3%, and the compensation arrangements for those coaches have become significantly more complex. The potent combination of increased congressional scrutiny accelerated salary inflation and varied forms of compensation give rise to a renewed focus on the manner in which compensation decisions are made. […] Noteworthy in the penalty structure, relative to intercollegiate athletics, is that athletics directors may be subjected to the tax both as a disqualified person (in connection with excess benefits paid to the athletics director) and as an organization manager (if the IRS were to determine that a head coach’s responsibilities and authority warrant a determination that the head coach is a disqualified person)." Nuanced as it may be (it's tax law, what do you expect?), this is a must read for ADs. The Oklahoma State facilities overhaul under AD Holder has kept its momentum with a recently announced $75M baseball stadium and a $20M soccer stadium that is nearly completed. Holder credits OSU benefactor Pickens' $165M donation that has helped transform the FB program as the catalyst for other donors: "He also inspired others to give. ... It inspired Mike and Anne Greenwood to help build this tennis complex. It inspired Neal Patterson, who unfortunately passed away this past summer, with his wife to build a soccer stadium. Now, we are here for the baseball stadium." Holder also cites an unwillingness to compromise through "value engineering" and taking on unreasonable debt as a guiding principle behind OSU's overhaul, adding that wrestling, which has not seen an upgrade since 1938, is likely to be the next step in OSU's athletic village. For the first time since it began playing MBB games in the FedEx Forum, Memphis did not receive a payment from the Memphis Grizzlies pursuant to the lease's attendance clause. The contract calls for the NBA team to pay Memphis $800K if the Tigers average at least 10,000 fans per game, a prorated payment for attendance between 6,000-10,000 and no payment for attendance below 6,000. Further, if average attendance dips below 6,000 for two consecutive seasons, the Grizzlies have the option to terminate Memphis' lease. As part of his contract, new HC Hardaway will receive a $300K bonus if average attendance climbs above 12,000 fans per game. The Tigers averaged 4,583 fans per home game this season. (link)
In a departure from previous years, New Mexico President Stokes will present the FY19 athletics budget proposal to the UNM Board of Regents' Finance and Facilities Committee tomorrow. It's unclear whether the proposal, which has been presented by an athletics official in past years, will recommend forgiving all or part of the department's deficit, which is expected to grow to $6.7M by the end of the fiscal year. During her first week on the job, Stokes responded to a question regarding the athletic department's debt by saying: "That’s a tough one for me to answer right now, because I don’t know what all the options are going to be. I’m recognizing this is a really big issue to be resolved, but I will say again, I’m not a big believer in simply forgiving debt that’s been accumulated in any unit, academic or otherwise." (link)

American Airlines announced Friday that it has ordered 47 Boeing 757 Dreamliners to replace much of its older long-haul fleet, effectively "terminating" the order for 22 Airbus A350s placed by US Airways. The estimated $12B deal will make American the largest Dreamliner customer in the western hemisphere. CFO Kerr: "We see significant advantages to carrying common fleet types, including creating less friction in our operation when aircraft swaps are necessary, reducing inventory needs, and creating a more consistent service for customers and team members." American will operate just three types of widebody jets going forward. (link)

Clemson AD Radakovich reveals some of the logic behind his decision last spring to bring back MBB HC Brownell, who last month led the Tigers to their first Sweet 16 appearance in 21 seasons. In addition to evaluating the team's performance, Radakovich took into account the team's Graduation Success Rate, which was 88 in 2017, Brownell's stature as a model member of the community, and whether the Tigers were progressing in a way that made sense. Radakovich: "All of those things were plus, plus, plus. By staying with Brad, he had another opportunity with a really experienced team coming back to be able to have some success." Now, Brownell is nearing an extension, and Radakovich can laugh off some of the fan base's criticisms from last year. "Any time you make a decision out of this office, I will tell you -- I don’t even think it’s rare, I think it’s extinct that there’s 100% approval. … You make your decision and you move ahead." In an interview with the Star-Telegram, UT Arlington AD Baker discusses a number of topics, including the controversial decision to part ways with former MBB HC Cross, saying the move was driven primarily by a decision to make it back to the NCAA Tournament. "Putting the university [on the map] in March. Look what it did to Loyola. Look what it did for the University of Maryland Baltimore County. That's what brings your university notoriety. That's where we want to strive." To those who were upset by the coaching change, Baker explains that "UTA should be bigger than one person. ... It's about UTA and your allegiance here. We want to continue to grow." Baker also addressed plans to increase UTA's budget, saying UTA has to get "sponsorships and continue to do those things in the community and grow our attendance. We start on Monday at looking at how we can do those kinds of things. It's a full-court press from this point on." (link)
Northwestern FB HC Fitzgerald lays down a challenge to Wildcats supporters in conjunction with the opening of the new Ryan Fieldhouse, "My hope is to move this needle as far as I possibly can with what I can do and what I can control in my role. There’s a lot of people that kinda need to come along with us. Am I being a little bold right now? Hell yeah, I am. That’s what my expectations are. So I’d like to see people raise to mine at some point here. I’m hoping that’s going to happen because we gotta keep doing it. We’ve won 27 games over the last three years, that’s top 15 in the country. Our attendance isn’t top 15 in the country. Our atmosphere isn’t top 15 in the country. We gotta get our students to come out and let’s get this thing going. This is a together thing. [...] I am going to challenge everybody that touches our program to step it up. Step it up. The University stepped it up. I think we’ve stepped it up on the field. We all now need to collectively step up the program. Quit bitchin’, quit belly-achin’, become part of the solution and let’s go. All of us. All of us collectively." (link)
Indianapolis Star columnist Osterman attributes Indiana's rise in baseball to "investment, patience, vision and undeniable luck," citing the program's once-"embarrassing" facilities and inability to tap into the Midwest's talent pool. Now, with the new Bart Kaufman Field and attendance successes in recent years, D1Baseball.com's Fitt says IU orchestrated an "incredible rise," adding: "To come from that to where they are right now is nothing short of remarkable." Meanwhile, 10innings.com publisher Webb, thinks it's IU's ability to sustain success that is most worthy of conversation: "It’s more, for me, what happened between [former HC] Tracy leaving to go to Arizona State and what’s happened in the four years since. There was a concern. Was it all (Smith’s) work? Would the program be able to sustain? ... What Indiana did, Indiana changed the conversation." (link)
La Salle is expected to name Villanova's top MBB AC Howard as the next HC for the Explorers on Monday. Howard, a local product, started his coaching career as an AC at LaSalle. Former Explorers MBB star Simmons: "The hire is well deserved. Ashley put in his dues, he’s a Philly guy and he deserves a shot. I think he’s going to help us a lot. We have had some tough years as of late. We are excited about the new hire and looking forward to Ashley turning us around. He’s been involved in Philly basketball forever, he brings a work ethic and an enthusiasm that can get the players motivated. That’s going to be his main focus, to get the guys motivated and heading in the right direction." Villanova MBB HC Wright calls it a "terrific selection" on La Salle's part. (link)

The George Washington Women's Rowing Team is allegedly being investigated by the Title IX office for an offensive photo circulated by the team on social media in recent days. The photo "targets and publicly humiliates a member of the men’s rowing team, depicting him as a dog, with an associated humiliating caption." Per the same source that revealed this investigation, the team was recently investigated over inappropriate alcohol-related photos that made the rounds on social media, as well. No comment from athletic department staff. (link)
More from Foggy Bottom as George Washington freshman Women's Rower Christensen pens an opinion piece for the school newspaper, says female student-athletes aren't treated the same as their male counterparts. "The largest complaint that I’ve heard from female athletes is that they feel like there is no one to talk to when it comes to reporting sexism and mental health issues. It can be very hard to go to a male coach or director and say, 'This is sexist,' or 'I’m having panic attacks.'" Christensen goes on to say at times she just feels like "just a body" & pushes for more female leadership within administrative ranks to make it easier for female student-athletes to talk to someone. (link)
The Wall Street Journal headlines with this: "Why Nike Should Be Scared of Women: News about the company's culture could turn off female customers who have been key to the company's growth." Last year Nike's women's business brought in more than $6.6B in revenue and it has grown roughly 12% annually since 2013, faster than the rate of the company overall. So far, investors at least are not too spooked, as Nike's shares rose 10% since the initial dip after WSJ reported last week on Nike's culture issues. (link)

The New Yorker's Owen profiles Finnish startup HappyOrNot's simple yet effective method of gauging customer satisfaction through its use of childlike buttons as deployed in a chain of European gas stations recently. Owen notes that HappyOrNot's simplicity (it's literally as easy as pushing a button) and ease of engagement enables it to be accessible to larger and more representative data sets. Owen contrasts that with traditional polling practices, even rating systems on major retail websites, to denote that regardless of sample size, those who leave rankings are often not representative of customer bases. HappyOrNot was also recently deployed at Levi's Stadium in San Francisco during a 49ers game, and Owen recalls seeing a fan press one of the buttons without a reason (a false negative). Owen notes the stakeholders appeared unconcerned: "When you receive twenty thousand impressions in the course of a few hours, as the 49ers do, the signal-to-noise ratio is necessarily high." (link)
