Europe, defend Poland’s Supreme Court!

An open letter to the European Commission

We, representatives of pro-democracy Polish civic organizations abroad, urge the European Commission to take immediate steps to prevent Poland from implementing a law that would erode the independence of Poland’s judiciary even further.

In the wake of its electoral victory in the fall of 2015,  the Law and Justice party has engaged in systematic subjugation of the judiciary to the executive branch of government, and it has politicized the justice system. In response, on numerous occasions, the European Commission has criticized a series of changes in laws governing Poland’s Constitutional Tribunal, ordinary courts, the National Council of the Judiciary, and the Supreme Court - changes deemed as unconstitutional and violating the fundamental principles of the separation of powers.

We appreciate and support the Commission’s efforts meant to defend and restore the rule of law in Poland. However, sadly, we see that so far these efforts have been to no avail: the Polish government has consistently ignored all recommendations and has not undertaken any actions that the Commission had called for pursuant to Article 7 of the Treaty on European Union.

The process of destruction of the independent judiciary in Poland is soon to be completed. On 3 July, nearly 40 percent of current Supreme Court judges might be forced into early retirement pursuant to the Supreme Court Act,  deemed unconstitutional. They will then be replaced by nominees of the already politicized National Judiciary Council, which is fully controlled by the executive branch of the government. This will constitute the final act of the governing party’s takeover of the courts.

The European Commission can prevent this scenario from unfolding - a scenario which, if it does take place, will have far reaching negative consequences not only for Poland, but also for the entire European Union. It is possible and imperative to take measures other than those outlined in Article 7 of the Treaty on European Union.

We appeal to the European Commission to immediately refer Poland’s Supreme Court Act to the Court of Justice of the European Union, under Article 258 of the Treaty on the Functioning of the European Union, and to file a motion for interim measures. Articles 37 and 111 of Poland’s Supreme Court Act infringe upon the principle on irremovability of judges, which is a key element of the independence of the judiciary; thus, these two articles are in conflict with Article 2 and Article 19 (section 1, third sentence) of the Treaty on European Union and Article 47 (second paragraph) of the EU Charter on Fundamental Rights.

In recent past, an application of similar legal measures effectively stopped the Polish government from continuing its destruction of the Białowieża Forest, a treasure of Europe’s natural environment. Furthermore, we expect that the European Commission shall continue to support the complaint submitted to the Court of Justice of the European Union in March 2018 on the matter of changes to Poland’s law on ordinary courts. The Court’s ruling will have to be respected by all parties to the dispute in Poland – including the opposition.

A ruling of the Court of Justice of the European Union will be critically important for the future of the Polish constitution and the rule of law in Poland. With the destruction of Poland’s Constitutional Tribunal already completed and the expected abolition of the the Polish Supreme Court’s independence, there will not be a single institution left in Poland with the power to declare that these laws, which severely undermined Poland’s political system, are invalid. In this predicament, relevant rulings of the Court of Justice of the European Union could serve as the only source of law on the basis of which it might be possible to eliminate the consequences of the present lawlessness.

An overwhelming majority of Polish citizens support Poland’s European integration. As citizens of the European Union, we consider the European Commission and the Court of Justice of the European Union to be also our institutions. A European Union based on the rule of law and civil liberties is our shared good. We cannot allow these values to be lost.

Europe, défends la Cour suprême polonaise !

Lettre ouverte à la Commission européenne

En tant que représentants d’organisations citoyennes de Polonais à l’étranger, nous appelons la Commission européenne à entreprendre sans tarder des actions afin d’empêcher le démantèlement déjà avancé de la justice indépendante dans notre pays.

Depuis la prise de pouvoir à l’automne 2015, le gouvernement du PiS (Droit et justice) a procédé à une mise sous tutelle systématique du système judiciaire le soumettant au pouvoir exécutif, ainsi qu’à la politisation de la justice. La Commission européenne a critiqué, à plusieurs reprises, les modifications non constitutionnelles et contraires aux règles fondamentales de l’État de droit, qui visaient le Tribunal constitutionnel, les juridictions de droit commun, le Conseil national de la magistrature et la Cour suprême.

Nous apprécions et soutenons les efforts de la Commission européenne pour défendre et restaurer l’État de droit en Pologne. Nous constatons avec regret qu’ils n’ont pas eu les effets escomptés : le gouvernement polonais continue d’ignorer toutes les recommandations les unes après les autres, et, par ailleurs, n’a effectué aucune action recommandée par la Commission en vertu de l’article 7 du Traité sur l’Union européenne.

Le processus de destruction des tribunaux indépendants en Pologne sera bientôt achevé.  Le 3 juillet prochain en vertu de la loi non constitutionnelle sur la Cour suprême, près de 40% de juges de celle-ci peuvent se retrouver forcés à prendre une retraite anticipée. Ce seront les magistrats nommés par le Conseil national de la magistrature déjà politisé et pleinement contrôlé par le gouvernement qui les remplaceront. Il s’agira du dernier acte de la prise des tribunaux par le parti au pouvoir.

La Commission européenne peut empêcher ce scénario qui, le cas échéant, aura les conséquences néfastes non seulement pour la Pologne, mais également pour toute l’Union européenne.  Il est possible et indispensable d’appliquer d’autres moyens que ceux prévus par l’article 7 du Traité de l’Union européenne.

Nous appelons la Commission européenne à saisir sans délai la Cour de justice de l’Union européenne contre la loi sur la Cour suprême, selon les modalités prévues par l’article 258 du Traité sur le fonctionnement de l’Union européenne, tout en déposant une demande de mesures provisoires. Les articles 37 et 111 de la loi sur la Cour suprême violent le principe de l’inamovibilité des juges, qui constitue l’élément fondamental de leur indépendance, et, de ce fait, ne sont pas conformes à l’article 2 et l’article 19, paragraphe 1, alinéa 2 du Traité sur l’Union européenne, ainsi qu’à l’article 47, paragraphe 2 de la Charte des droits fondamentaux de l’Union européenne.

Récemment, une telle mesure a été employée avec succès contre le gouvernement polonais. Ainsi la destruction de la forêt primaire de Białowieża, un des trésors de la nature européens, a pu être stoppée. Nous espérons par ailleurs, que la Commission maintienne son recours déposé devant la Cour de justice de l’UE en mars 2018 concernant la loi sur l’organisation des juridictions de droit commun. L’arrêt de la Cour de justice devra être respecté par toutes les parties du conflit en Pologne, y compris l’opposition actuelle.

L’arrêt de la Cour de justice est vital pour l’avenir de la constitution polonaise et l’État de droit. Après la destruction du Tribunal constitutionnel et la liquidation prévue de la Cour suprême, en Pologne il n’y aura plus d’institution compétente pour invalider les lois qui viennent de détruire le système judiciaire polonais. Les arrêts de la Cour de justice de l’Union européenne sont aujourd’hui le seul recours dans le processus de l’annulation des effets néfastes du non-droit actuel.

Les électeurs polonais soutiennent l’intégration de la Pologne au sein de l’UE. La Commission européenne et la Cour de justice de l’Union européenne nous appartiennent aussi à nous, les Polonais - citoyens européens. L’Union reposant sur l’État de droit et les libertés civiles est notre bien commun. Il nous est impossible d’accepter la perte de ces valeurs.

An Europa: der polnische Oberste Gerichtshof braucht Hilfe!

An die Europäische Kommission

Als die im Ausland lebenden Unterstützer der Bürgerrechtsbewegungen in Polen fordern wir die Europäische Kommission auf, unverzüglich Maßnahmen zu ergreifen, damit der schrittweise Abbau der unabhängigen Justiz in unserem Land verhindert werden kann.

Seit der Machtergreifung im Herbst 2015, unterwirft sich die PiS - Regierung systematisch die Judikative und die Exekutive und versucht das Justizwesen zu instrumentalisieren. Die Europäische Kommission hat wiederholt die verfassungswidrigen und gegen die Grundprinzipien der Gewaltenteilung verstoßenden Gesetze über oberstem Verfassungsgericht, über ordentlichen Gerichten, über Nationalem Gerichtsrat und über Oberstem Gerichtshof kritisiert.

Wir begrüßen und unterstützen die Bemühungen der Kommission zur Verteidigung und Wiederherstellung der Rechtsstaatlichkeit in Polen. Wir bedauern, dass sie bisher keine Wirkung gezeigt haben: die polnische Regierung hat alle Empfehlungen konsequent ignoriert und die von der Kommission gemäß Artikel 7 des EU - Vertrags geforderten Maßnahmen nicht ergriffen. 

Der Prozess der Abschaffung der freien Gerichte in Polen wird bald abgeschlossen sein. Am 3. Juli können fast 40% der Richter des Obersten Gerichtshofs gemäß der verfassungswidrigen Änderung des Gesetzes über Oberstem Gerichtshof gezwungen sein, in den Vorruhestand einzutreten. Sie werden durch Kandidaten aus dem bereits von der Regierung vollständig kontrollierten Nationalen Gerichtsrat ersetzt. Dies wird der letzte Akt der Übernahme der Gerichte durch die Regierungspartei sein.

Die Europäische Kommission kann dieses Szenario verhindern,  das ansonsten weitreichende negative Folgen nicht nur für Polen, sondern auch für die Europäische Union insgesamt, haben kann. Andere, als die im Artikel 7 des EU - Vertrages vorgesehenen Maßnahmen, sind möglich und erforderlich. .
Wir fordern die Europäische Kommission auf, den Gerichtshof der Europäischen Union gemäß Artikel 258 des Vertrages über die Arbeitsweise der Europäischen Union unverzüglich mit dem Gesetz über den Obersten Gerichtshof zu befassen und vorläufigen Rechtsschutz zu beantragen. Die Artikel 37 und 111 des polnischen Gesetzes über den Obersten Gerichtshof verletzen den Grundsatz der Unabsetzbarkeit der Richter, der ein wesentliches Element der Unabhängigkeit der Richter ist. Somit sind diese Art. mit dem Art. 2 und Art. 19 Abs. 1 Satz 3 des Vertrages über Europäische Union i. V. m. Art. 47 Abs. 2 der Charta der Grundrechte der Europäischen Union unvereinbar.

Vor kurzem wurde ein solches Verfahren effizient gegen die polnische Regierung umgesetzt, um die Zerstörung des Urwaldes Białowieża, eines der Schätze der europäischen Natur, zu verhindern. Wir erwarten auch, dass die Kommission die Klage bei dem EuGH vom März 2018 gegen die Änderung des Gesetzes über die ordentlichen Gerichte weiterhin unterstützt. Das Urteil des Gerichtshofs muss von allen Konfliktparteien in Polen, einschließlich der Opposition, respektiert werden.

Das Urteil des Gerichtshofs ist von entscheidender Bedeutung für die Zukunft der polnischen Verfassung und der Rechtsstaatlichkeit. Angesichts der Zerstörung des obersten Verfassungsgerichts und der erwarteten Auflösung des unabhängigen Obersten Gerichtshofes wird es in Polen keine Institution mehr geben, die die für den polnischen Rechtssystem schädlichen Gesetze für ungültig erklären kann. Es sind die Urteile des Gerichtshofs der Europäischen Union, die als einzige Rechtsquelle herangezogen werden können, um die Auswirkungen der gegenwärtigen Gesetzlosigkeit zu beseitigen.

Die polnischen Wähler unterstützen die europäische Integration des Landes. Die Europäische Kommission und der Gerichtshof der Europäischen Union sind auch unsere Institutionen als Bürger der Europäischen Union. Eine auf Rechtsstaatlichkeit und bürgerlichen Freiheiten basierende Union ist unser gemeinsames Gut. Wir dürfen nicht zulassen, dass diese Werte verloren gehen.
