Raw Milk Decision Expected on Friday September 16


NEWMARKET, ON: Dairy farmer Michael Schmidt will find out on Friday, September 16, 2011 whether the Ontario Court of Justice will uphold or reverse last year’s “not guilty” verdict on 19 charges relating to the distribution of raw milk.

Schmidt’s lawyer is Karen Selick, Litigation Director with the Canadian Constitution Foundation. She expects to receive the decision of Justice Peter Tetley by fax on the morning of September 16, 2011.

Chronology:
  • November, 2006—Schmidt’s farm is raided by 24 armed officers from OPP and Ministry of Natural Resources
  • January 26 to February 4, 2009—Schmidt’s trial is held in Newmarket, Ontario
  • January 21, 2010—Justice of the Peace Paul Kowarsky pronounces Schmidt “not guilty” on all 19 charges
  • February, 2010—Appeals launched by Ministry of Natural Resources and Grey Bruce Health Unit
  • April 13, 2011—Appeal argued before Justice Peter Tetley, Ontario Court of Justice
