KLF Client Alert

Executive Order "Suspending Immigration" Released

Further to our previous client alert, President Trump's Executive Order purporting to "suspend immigration" has finally been released and you can view it here.

As we had thought, its scope is fairly limited and it only affects immigrant visa applicants who were already affected by the temporary suspension on visa processing.  Immigrant visas are issued to foreign nationals currently outside the United States and provide them with permanent resident status upon entry to the United States.

Those who already hold valid immigrant visas will still be able to enter the United States during the validity period of the visa.

The Executive Order does not affect nonimmigrant entries (e.g., H-1B, L-1, O-1, E-1, E-2, E-3, TN, etc.), or foreign nationals already in the United States, including those applying for extensions of status, changes of status, or permanent residence through adjustment of status.
