90-Day Duty Postponement Available in Certain Circumstances

In response to the economic hardship experienced by companies due to the COVID-19 outbreak, Customs has announced a process to postpone duty collections for up to 90 days. This temporary action has limitations and is not available for all entries.

To be eligible, an importer must be able to show that their operation has been fully or partially suspended during the months of March and/or April due to governmental orders limiting commerce, travel or group meetings due to COVID-19. Further, the gross receipts for the importer must be down at least 60 percent from a comparable time period in 2019.

The duty postponements do not apply to entries which include merchandise subject to the following:
  • Anti-dumping or countervailing duties.
  • Products subject to Section 232 duties (steel & aluminum).
  • Products subject to Section 301 duties (certain items from China and EU).
  • Products subject to Section 201 duties (certain washing machines and solar panels).
Interest will not accrue for the postponed duty payments. The postponement will not apply to shipments which have already been filed, Customs will not adjust statement dates. Further, the postponement applies only to the scheduled payment of duty and fees and does not apply to other debts payable to Customs.

Postponements can be made to payments on either Daily or Periodic Monthly Statements (PMS). Please note that any adjustments to the April PMS must be made before midnight tonight. Please read the Customs guidelines below for more information and contact CVI if you are interested postponing your duties ASAP.
