In my favorite Seinfeld episode,
The Caped Lawyer, Larry David – who else? – stars as Frank Costanza’s lawyer...in a cape! Is there a message? Maybe it’s lawyers shouldn’t take themselves so seriously! 😂 😂 😂 😂
While times are tough,
This is a Great Time for Design and Construction – if you are interested in new approaches to align parties’ incentives, realize greater efficiencies, and to disrupt and improve the industry. I was floored by a brilliant keynote from a visionary engineer, so I wrote that piece – with video and podcast links – to spread the word!
Mechanics liens are an increasingly hot issue, sadly, as COVID-19 halts more projects. Here’s something you might not know:
Diligent Project Owners Should Never Lose Mechanics Lien Claims. I help project owners and developers
defeat lien claims. I also help architects, engineers, and contractors
use liens to get paid. I would much rather negotiate contracts than deal with claims. But much of my work is liens these days.
In firm news, I was fortunate to collaborate with both AIA National and AIA Chicago in April. For
AIA Chicago, I led a presentation entitled “
Using Mechanics Liens to Get Paid: A Primer for Architects in the COVID-19 Era” for over 100 attendees. I was also the guest for an
AIA Contract Documents Video Podcast, entitled “Mechanics liens and Other Payment Issues During COVID-19,” with sharp AIA in-house attorneys. Click the links to watch!
My mission is to help people who design and construct buildings enter into good contracts, avoid disputes, and have their expectations met with ‘win-win’ outcomes.
I am happy to provide this monthly e-newsletter, with links to my
video library, recent
blog posts, and
firm news, plus tips and information about Seinfeld,
design and construction law, picking the right
project delivery method, negotiating
good contracts, proactive
dispute avoidance and, when necessary,
mediation,
arbitration, and
litigation.
