BIICL publishes a Concept Note on the effects of the pandemic on commercial contracts and legal consideration in mitigating mass defaults

A note agreed by senior judges and academics, at a meeting held by the British Institute of International and Comparative Law (BIICL), has called for ‘breathing space’ in commercial contract disputes arising from the current Covid-19 pandemic: www.biicl.org/breathing-space 

The concept note, which was reported on BBC Radio 4’s Today this morning (27 April 2020 - interview at 2h33m) and in the Financial Times, was agreed at a meeting held by BIICL of former Presidents of The UK Supreme Court, Lord Phillips and Lord Neuberger, as well as Sir David Edward, Sir William Blair, Professor Spyros Maniatis, Professor Malik Dahlan and Keith Ruddock.

Speaking on the BBC's Today programme, Lord Neuberger, former President of the UK Supreme Court, introduced the breathing space project, saying that “the legal world has a duty to the rest of the world to prepare itself”. BIICL will contribute to this as a global exchange of ideas hub; details of forthcoming virtual conversations will follow.
