A COVID-19 Update from CalChiro
 
CalChiro continues to receive inquiries on a variety of topics specific to the COVID-19 pandemic, particularly related to policies/procedures that may have been enacted in response to the delivery of services by providers, including doctors of chiropractic during this pandemic. CalChiro encourages you and your staff to access on a regular basis health plan websites that outline provider information, including but not limited to waiver of copayments for members/patients, telehealth services, and clinical management oversight. As CalChiro has communicated previously, if it is determined that a global issue of denial or other inappropriate activities by a full-service health plan and/or its’ delegated entities, CalChiro will advocate reversal of those activities.

CalChiro is hearing from members that patients are beginning to schedule appointments for services to attend to their health care needs. This indeed is very good news, but keep in mind that appropriate public health procedures remain in place. And, as noted above ensure you have the most up-to-date information related to the member/patient benefits, and your requirements as a contracted provider. These are challenging times for all but CalChiro has heard from providers their practitioners have regained up to 80% capacity. All these opportunities to provide patient care assists the profession in working with elected policy-makers and regulators to demonstrate the chiropractic profession’s commitment to public health through the services doctors of chiropractic provide.
Chiropractic in the COVID-19 Pandemic Era

Coronavirus disease 19 (COVID-19) has had dramatic effects on many aspects of life, as the world struggles to deal with its many ramifications. As of late-April 2020, nearly 3.2 million around the world have been infected, and 226,000 have died. In the U.S., more than one million people are confirmed to be infected according to the Johns Hopkins Coronavirus Resource Center. [1]

Doctors of Chiropractic want to help, but the role of D.C.’s has been the subject of controversy both within and outside of the profession. This is a consequence of claims made by some D.C.’s about the capacity for manipulation to prevent or treat COVID-19, as well as a lack of understanding of the role D.C.’s can play in this crisis. As of this writing (late-April 2020), though there are some promising approaches, there are no reliably confirmed treatments or preventive strategies of any kind for Coronavirus -19 infection except social (physical) distancing and practices such as wearing masks, hand washing, and other hygiene measures. There are no medical treatments or chiropractic treatments shown to have any reliable efficacy.

HHS Payment Attestation Clarification

The ACA has received several inquiries about attestation requirements in the Department of Health and Human Services (HHS) Terms and Conditions document related to the recent funds made available to Medicare providers, including chiropractors.

Specifically, some chiropractors have asked, while it may be likely most DCs treated a patient who may have had COVID-19, but are they going to have to prove that? Also, how do they illustrate the money was used to prevent, prepare for, and respond to coronavirus? Is just agreeing to the terms and conditions enough proof?

New Information Regarding Massage Therapy Use in Practice

I am a Massage Therapist who works for a physician or chiropractor providing massages. Can I provide massage now while working for them?

The Director of the California Department of Health Services has recently stated that CAMTC Certificate Holders who work for physicians or chiropractors that are resuming deferred or preventative health care services, based on the State’s new guidelines, may resume practice as long as the local jurisdiction also allows it to occur. Please see relevant guidelines HERE.

While the State is allowing deferred and preventative health care to occur, it has also acknowledged that cities and counties may be experiencing larger numbers of local outbreaks of coronavirus. Therefore, cities and counties have the authority to impose stricter restrictions than the State. If you are a Massage Therapist, please make sure that you are meeting State AND local requirements if you resume practicing for a physician or chiropractor.

COVID-19 Prior Authorization and Ongoing Patient Care Updates

UnitedHealthcare is working to help people access health care to the fullest extent possible as we come together to address this national emergency. We’re adopting measures that will reduce administrative burden for physicians and facilities and help members more easily access the care they need under their benefit plan.

NEW – Waiving Cost Share for Medicare Advantage Members for Both Primary and Specialty Care Office Visits

UnitedHealthcare is waiving cost share (copays, coinsurance and deductibles) for UnitedHealthcare Medicare Advantage plan members for all office-based professional services performed by both primary care physicians and specialists. This applies for dates of service starting May 11, 2020 until at least Sept. 30, 2020. Waiving cost share for primary care and specialty care, along with our telehealth cost share waiver, can make it easier for members to get the care they need, however they choose to access it.

Press Release: Senate Leaders Unveil Proposed State Budget Approach, Proposal to Aid California’s Economic Recovery

SACRAMENTO – As the California State Senate returns to the Capitol and resumes session this week, Senate President pro Tempore Toni G. Atkins (D-San Diego), along with Senators Holly J. Mitchell (D-Los Angeles), Steven Bradford (D-Gardena), and Robert M. Hertzberg (D-Los Angeles), unveiled the Senate Democratic Caucus’ proposal for the state budget and California’s economic recovery.

The budget approach aims to keep the budget balanced over a multi-year period through pragmatic spending decisions, use of reserves and other traditional solutions, and federal support. Senate Democrats also are proposing two specific recommendations that would aid California in rebounding from the deep economic impacts of the COVID-19 health crisis. As California so often leads the way, our roadmap to a just and equitable recovery can serve as a model for the rest of the nation.

Understanding Personal Protective Equipment

As states are starting to allow practices to see patients in person again, they are also putting conditions and requirements around the reopening. One of those conditions will most likely surround the use of personal protective equipment (PPE). Since this term has been a big part of our awareness since COVID-19 came into the picture, it is an opportune time to review what is considered PPE. The second issue is going to be whether you permit or require your staff to wear PPE. First, let’s agree that you have a duty to protect both your patients and your staff. By protecting one, hopefully you are protecting all.

Preparing for a New Normal

Weideman Group COVID-19 Updates

Governor Gavin Newsom released his updated state budget proposal for fiscal year 2020-2021 (referred to as the May Revise). California began 2020 with a strong economy, historic reserves, a structurally balanced budget, and a projected surplus of $5.6 billion. However, the Department of Finance (DOF) now predicts revenue declines of $41.2 billion due to job losses and business closures. This is combined with an expected $7.1 billion in caseload increases for health and human services programs and other expenditures of approximately $6 billion - the majority in response to COVID. DOF now estimates that the overall bu​dget deficit is approximately $54.3 billion, of which $13.4 billion occurs in the current budget year (2019-2020) and $40.9 billion in the 2020-21 budget year (which begins July 1, 2020). For reference, this overall deficit is nearly 37% of the General Fund spending authorized in last year’s budget.

Federal Law Alert: New I-9 Policy Due to COVID-19

The Department of Homeland Security (DHS) has issued a temporary policy to allow employers to accept expired List B documents when completing the Form I-9 beginning May 1. This policy is intended to account for the fact that many people are unable to renew their driver’s licenses or state ID cards at this time due to stay-at-home orders. While some states have extended the expiration of driver’s licenses and state identification cards, which are common List B documents, others have not. The temporary policy addresses both situations.

Temporary Extension for Expired List B Documents That Have Not Been Extended

List B documents that expire on or after March 1, 2020, and have not been extended by the state may be treated the same as if the employee presented a valid receipt for an acceptable document for Form I-9 purposes.

If an employee presents their driver’s license that expired on or after March 1 and it was not extended by the state, employers should:
  • Record the documentation information in Section 2 under List B, as applicable; and
  • Enter the word “COVID-19” in the Additional Information field.

Question: What should I do if my employee discloses that their family member or roommate has COVID-19?

ANSWER: Employees who have come within six feet of someone who is infected should self-quarantine for 14 days after their last exposure per the Centers for Disease Control and Prevention (CDC). During this time, they should take their temperature twice a day and watch for symptoms of COVID-19. Currently, the known symptoms of COVID-19 include fever, cough, sore throat, muscle pain, chills, new loss of taste or smell, or shortness of breath.

Because COVID-19 is widespread in so many communities, the CDC recommends that everyone practice social distancing, be alert for COVID-19 symptoms, and follow CDC guidance if symptoms develop.

Remember to maintain the confidentiality of all employees’ medical information, which includes symptoms as well as the lack of symptoms.
An Update from UnitedHealthcare
 
In a notice dated May 4th, UnitedHealthcare announced that they will reimburse telehealth services submitted by chiropractors when provided by qualified health care professionals and rendered using interactive audio-visual technology for Medicaid, and Individual and fully insured Group Market health plan members. Medicare Advantage coverage limitations still apply, as well state laws and regulations. Benefits will be processed in accordance with the member’s plan.

Cost-sharing will be waived for in-network telehealth visits for chiropractic services from March 31, 2020 until June 18, 2020 for Medicaid, Individual and fully insured Group Market health plan members, with opt-in available for self-funded employers.

This change is effective for dates of service from March 18, 2020 until June 18, 2020.
Reimbursable codes are limited to the specific set of codes listed here. UnitedHealthcare will reimburse eligible codes on a CMS 1500 form using the place of service that would have been reported had the services been furnished in person along with a 95 modifier, or on a UB04 form with revenue code 780.

UnitedHealthcare is temporarily expanding care provider telehealth access for Medicaid, and Individual and fully insured Group Market health plan members by reimbursing claims submitted by chiropractors for certain services performed using live video-conferencing while a patient is at home. This change applies for dates of services from March 18, 2020 until June 18, 2020. Benefits will be adjudicated and claims will be processed in accordance with the member’s benefit plan and your participation agreement (if applicable). State law and licensing board requirements apply to all providers’ provision of chiropractic services through telehealth.

UnitedHealthcare will reimburse claims including one of the CPT® codes from the list, as long as claims are submitted on a CMS 1500 form using the place of service that would have been reported had the services been furnished in person along with a 95 modifier, or on a UB04 form with revenue code 780. These coding rules apply to all lines of business.

Please CLICK HERE to see CPT codes that are accepted until June 18, 2020 under this policy change. UnitedHealthcare will not reimburse providers for audio-only visits. All visits must be performed using live video-conferencing that involves the presence of both parties at the same time and a communication link between them that allows a real-time audio and visual interaction to take place. E-mailing “stored” exercise videos and discussing or reviewing by phone is not reimbursable. Providers must always comply with the requirements of the state that issues their license in providing services.
DWC Update on Proposed Emergency QME Regulations: Comments Accepted through Tuesday, May 12

The Division of Workers’ Compensation (DWC) advises that in response to COVID-19, proposed emergency regulations for Qualified Medical Evaluations (QMEs) were posted on the state’s Office of Administrative Law (OAL) website on May 7, 2020.

Pursuant to section 55 of title 1 of the California Code of Regulations, comments were submitted to OAL and DWC through May 12, 2020.

F4CP and ChiroCongress Launch National ChiroCares Giving Back Day, May 19

San Jose, CA. – May 12, 2020 – The Foundation for Chiropractic Progress (F4CP), a not-for-profit organization dedicated to educating the public about chiropractic care, in collaboration with ChiroCongress, a national organization representing State Chiropractic Associations across the U.S. and in Puerto Rico, are teaming up to launch National ChiroCares Giving Back Day on May 19, 2020. Chiropractic State Associations across the nation, along with their members, will organize and participate in different events that give back to their local communities during the global COVID-19 pandemic.

“ChiroCongress has been in constant communication with the leadership of its State Associations amid the pandemic, and we have been brainstorming ways in which doctors of chiropractic can give back to the communities in which they serve,” states Elizabeth Klein, executive director, ChiroCongress. She continues, “A National ChiroCares Giving Back Day not only symbolizes the power of positivity within the chiropractic profession, but it further exemplifies our doctors of chiropractic commitment as healthcare providers and as pillars of their communities, ready and willing to help those who are in need.”
