Dear Students and Scholars:

On May 29th, 2020 President Trump signed a Presidential Proclamation limiting the entry of certain Chinese nationals on F and J visas into the US. It specifically applies to individuals wishing to pursue graduate studies or research, who are affiliated with an entity in the PRC that implements or supports the PRC’s “military-civil fusion strategy” and who meets the following criteria:
  • Is currently receiving funding, 
  • is employed by, 
  • studies at, 
  • conducts research at or on behalf of, 
  • has been employed or studied at, 
  • conducted research at or on behalf of such an entity.
This proclamation is to be applied to individuals seeking to enter the US. In addition, it makes provision for the possibility that it could be applicable to nationals already in the US on a F or J visa and who otherwise meet these criteria through a review and revocation of their visas by the Department of State.  

The Proclamation does not apply to the following:
  • US permanent residents
  • Spouse or children of US residents or citizens
  • Members of US Armed Forces
  • Those subject to international agreements
  • “Any alien who is studying or conducting research in a field involving information that would not contribute to the PRC's military‑civil fusion strategy”
  • Those benefiting law enforcement
  • Those benefiting US national interest
The Proclamation calls for the Secretary of the Department of State and the Department of Homeland Security to recommend within 60 days additional measures that the President can take to “mitigate the risk posed by the PRC’s acquisition of sensitive US technologies and intellectual property.” The DOS and DHS is directed to develop supporting regulations and policies.

The Proclamation is effective June 1, 2020 and is to remain in effect indefinitely. 

Please note that BIO is still analyzing the Proclamation and is seeking to learn new information about its implementation. At this time we are not aware of the specific entities or areas of study and research that this proclamation covers.
