On Monday, June 22nd, 2020, President Trump signed a new Executive Order, “Presidential Proclamation Suspending Entry of Aliens Who Present a Risk to the U.S. Labor Market Following the Coronavirus Outbreak.” This order is to take effect at 12:01 a.m. on June 24th, 2020.
Who is NOT impacted by the proclamation?
This proclamation does NOT impact individuals in the United States on the effective date of the proclamation. This includes persons who currently hold H-1B status or are awaiting approval of H-1B change of status or extension of status petitions.
Additionally, the proclamation does not impact the following:
- F-1 or J-1 students (including the OPT/STEM OPT program). Our understanding is that the J-1 Student Intern category is also not included since it is a student category and differs from the J-1 Intern category.
- J-1’s in the Research Scholar, Short Term Scholar, and Specialist categories.
- Any lawful permanent residents.
- Spouse or children of U.S. citizens
- Individuals seeking to enter the U.S. to provide temporary labor or essential services to the U.S. food supply chain
- Any individual whose entry would be in the national interest
Who IS impacted by the proclamation?
The entry of any individual into the U.S. in the visa categories below is temporarily suspended until December 31, 2020 unless the visas were approved by a US Consulate prior to June 24, 2020:
- An H-1B or H-2B visa and anyone accompanying these individuals
- A J visa in the following categories: Intern, Trainee, Teacher, Camp Counselor, Au Pair, or Summer Work, and anyone accompanying these individuals
- An L visa and anyone accompanying these individuals
The proclamation applies to any individual outside the U.S. on the effective date of the proclamation (1) Who does not have a nonimmigrant visa that is valid as of the effective date of the proclamation, and (2) Does not have an official travel document other than a visa.
In addition, the April 22nd, 2020 Proclamation (Suspension of Entry of Immigrants Who Present a Risk to the U.S. Labor Market During the Economic Recovery Following the 2019 Novel Coronavirus Outbreak) has been extended to December 31, 2020.
