Alabama Statute 2019-489 Impacts
Probate and Administration of Alabama Estates
starting September 1, 2019
The Alabama Family Trust staff received several responses regarding the email we sent on Thursday, August 15 regarding Act 2019-489. This email clarifies a few points.
- Alabama Family Trust did not write or endorse Act 2019-489. Once it was obvious the Act was going to occur though, our Board President assisted in drafting the process details of Act 2019-489 in order to minimize the time and effort required of lawyers and familes of the deceased.
- Alabama Family Trust has no ability whatsoever to object to or change Act 2019-489. If you want to object to the Act, you can contact your legislators or take whatever actions you believe are appropriate.
- Information or documents provided by Alabama Family Trust is a public service and you can certainly use other documents. Based on feedback, we have updated the Notice by removing the electronic sign fields and have made other minor changes to the Affidavit posted on our "For Attorneys" webpage: https://www.alabamafamilytrust.com/for-attorneys/
A goal of Alabama Family Trust is to provide information that helps you in your practice involving special needs trusts. Thanks for the feedback and comments, and we hope we have clarified our limited role with this new requirement.
If you have additional questions, we encourage you to read the entire Act here: https://www.alabar.org/assets/2019/07/Act2019-489.pdf
