Spotlight on DACA
Part I: DACA and the Supreme Court
DACA Before the Supreme Court
Last month, the Supreme Court heard oral arguments regarding the fate of DACA- the Deferred Action for Childhood Arrivals program, which began under President Obama and allows children brought to the US without formal US authorization, to live and work in the United States. Several lower courts agree that the Trump administration acted improperly when it announced it was winding down DACA, yet the Supreme Court agreed to hear the case. That in itself was seen as a sign that the now conservative majority court was likely to reverse the lower courts’ decision.
What was at the basis of the legal action and what are possible outcomes?
This article written on the eve of oral arguments in November, addresses those questions and why the Supreme Court’s very hearing of the case, goes against the court’s modus operandi of typically addressing cases with “important questions of federal law” while in this case, the legal matter is actually incredibly small.
How long has DACA been tied up in the court systems? What are the two specific questions before the Supreme Court and what about those states that sued the US government for even creating DACA? The Immigration Response Team here at the University of MN put together this very useful and simple infographic and timeline.
What do colleges and Universities say about and how do they position themselves in relationship to DACA? The President’s Alliance on Higher Education and Immigration consists of 400+ member institutions in 32 states dedicated to increasing public understanding of how immigration policies and practices impact students, campuses and communities. Their work includes an Amicus Brief urging the Supreme Court to protect DACA. The Alliance has put together ideas and considerations to support various funding options for undocumented students.
Here at the University of MN, the Immigration Response Team (IRT) provides immigration resources and support to students, staff and faculty affected by immigration policy and changes. The IRT also provides regular updates and outreach to the greater University community on the impact of executive orders and other policy changes, immigration regulations, and issues connected with DACA and immigration status.
Individuals with immigration-related questions can either attend the Immigration Response Team's Drop-in Hours or email immigration@umn.edu to make an appointment. The IRT's Director, Marissa Hill-Dongre, is an immigration attorney who can provide support and connect individuals to community resources.
