Students, Concussions & Brain Injuries
A new study released in the journal of Pediatrics shared concussion incidents and trends in 20 high school sports both in practice and in games. The study looked at the 2013–2014 to 2017–2018 school years. Overall there were 9542 concussions reported. The good news is in all sports, recurrent concussion rates have decreased. The bad news is concussion rates have increased in football games. In addition, boys’ football, girls’ soccer and boys' ice hockey round out the top three sports with the highest concussion rates. The study found that across all sports, most concussions -- 63.7% -- occurred during competitions. Only one sport had a concussion rate higher in practice than in competition: cheerleading. While it is hoped that the decrease in concussion rates is attributed to changes in concussion incidence, diagnosis, and management, there are still more than 800,000 traumatic brain injury-related emergency department visits, hospitalizations and deaths that occur in children every year.
Vaping is an emerging public health threat. The e-cigarette industry has been mostly unregulated and has created a new generation of teen nicotine addicts. The National Institute of Health reports that more than one in four high school students in the U.S. use e-cigarettes. To date more than 38 people have been killed as a result vaping with hundreds of new outbreaks of vaping-related lung diseases leaving victims hospitalized and on ventilators fighting for their lives.
There are new lawsuits against the makers of e-cigarettes – JUUL is one of them, which owns 70% of the vape market. Victims suing JUUL allege that the company lied about its claim of being a safer alternative to smoking cigarettes. The company failed to disclose how much nicotine is in their product and that it is very addictive. Victims also claim that the company fraudulently markets to children promoting a variety of flavors (chocolate, mango, and mint) that are in sleek devices (watches, hoodies, and zip drives) that are easy for kids to use and hide from adults. In addition, some victims claim the products are defectively designed and are dangerous to users, and that the company failed to warn consumers of these dangers.
Attorney John Willis represented a man who was riding his motorcycle through a shopping center parking lot when he unexpectedly hit a deep pothole. The weather was poor at the time, filling the pothole with water, and effectively making it invisible to him. Our client required four days of hospitalization for a fractured fibia and tibia. We were able to obtain a $190,000 settlement to compensate our client for damages including outstanding medical bills and future medical expenses.
