Use of a 'Tapback' or Similar Reaction to Electronic Correspondence (I)

Division: I
Date Published: November 06, 2019
Item Ref:  1

Interpretation:

The Legislative Committee determined that it is not permissible to send a “Tapback” or similar reaction in response to a prospective student-athlete’s message via electronic correspondence (e.g., iMessage, text message) before the permissible date when an institution may begin to provide recruiting materials to the prospective student-athlete.

[References: Bylaws 13.4.1.7 (electronic correspondence – general rule), 13.4.1.9 (responding to prospective student-athlete's request)]

13.02.13 Prospective Student-Athlete. A prospective student-athlete is a student who has started classes for the ninth grade. In addition, a student who has not started classes for the ninth grade becomes a prospective student-athlete if the institution provides such an individual (or the individual's family members or friends) any financial assistance or other benefits that the institution does not provide to prospective students generally. An individual remains a prospective student-athlete until one of the following occurs (whichever is earlier): (Revised: 1/11/89, 1/10/90, Adopted: 4/28/05, 1/17/09, 1/19/13 effective 8/1/13, 4/25/18, 1/23/19)

(a) The individual officially registers and enrolls in a minimum full-time program of studies and attends classes in any term of a four-year collegiate institution's regular academic year (excluding summer);

(b) The individual participates in a regular squad practice or competition at a four-year collegiate institution that occurs before the beginning of any term;

(c) The individual participates in required summer athletic activities before his or her initial full-time enrollment at the certifying institution;

(d) The individual officially registers, enrolls and attends classes during the certifying institution's summer term prior to his or her initial full-time enrollment at the certifying institution; or

(e) The individual reports to an institutional orientation session that is open to all incoming students within 14 calendar days prior to the opening day of classes of a regular academic year term.

13.02.13.1 Exception -- After Commitment. After an individual has signed a National Letter of Intent or the institution's written offer of admission and/or financial aid or after the institution has received his or her financial deposit in response to its offer of admission, the individual shall no longer be subject to the restrictions of Bylaw
13.1. The individual remains a prospective student-athlete for purposes of applying the remaining provisions of Bylaw 13 and other bylaws. In basketball and football, for institutions that subscribe to the National Letter of Intent program, this exception does not apply to an individual who only signs an institution's written offer of admission and/or financial aid prior to the initial regular (as opposed to early) signing date of the National Letter of Intent program in the applicable sport. In sports other than basketball and football, for institutions that subscribe to the National Letter of Intent program, this exception does not apply to an individual who only signs an institution's written offer of admission prior to the initial signing date of the National Letter of Intent program in the applicable sport. (Adopted: 4/28/05, Revised: 1/19/13 effective 8/1/13, 4/28/16 effective 8/1/16, 7/9/18)

13.10.2 Publicity Before Commitment.

13.10.2.1 Comments Before Commitment. Before the signing of a prospective student-athlete to a National Letter of Intent or an institution's written offer of admission and/or financial aid or before the institution receives his or her financial deposit in response to its offer of admission, a member institution may comment publicly only to the extent of confirming its recruitment of the prospective student-athlete. The institution may not comment generally about the prospective student-athlete's ability or the contribution that the prospective student-athlete might make to the institution's team; further, the institution is precluded from commenting in any manner as to the likelihood of the prospective student-athlete committing to or signing with that institution. [D](Adopted: 1/19/13 effective 8/1/13)
