BREAKING: ONTARIO GOVERNMENT INTRODUCES LEGISLATION TO STOP VIGILS, ACTIONS AT FARMS
The Ontario government is proposing to make it illegal to bear witness at Animal Vigils and do actions such as Meat the Victims. Bearing witness is a moral duty and recognizes pigs, cows, chickens and other animals as sentient beings with individual personalities who deserve to live. Who is willing to challenge this draconian law outlawing bearing witness? Who would commit civil disobedience to make bearing witness not only a right, but a duty? #bearwitnessinOntario
Backgrounder
Ontario Introduces Security from Trespass and Protecting Food Safety Act, 2019

The proposed Security from Trespass and Protecting Food Safety Act, 2019, if passed, is intended to keep Ontario's farmers, their families, agri-food workers and farm animals safe by reducing the likelihood of trespassing on farms and processing facilities. The proposed legislation also enhances protections from obstructions in the transportation of livestock.
The proposed legislation would address unique risks and challenges associated with trespassing onto a farm or into a food processing facility.
Targeting specific areas
The proposed legislation would create "animal protection zones" on farms, processing facilities and other prescribed premises. Animal protection zones include animal enclosures, areas marked with signs in accordance with regulations and other areas on the property the Minister may prescribe.
The proposed Act would apply to animal enclosure regardless of whether there is any signage related to trespass or biosecurity.
Providing greater deterrents to trespass
The proposed legislation would recognize the unique risks and further deter trespass on farm or food processing facilities and obstructions to farm animal transport by:
  • Providing escalating fines of up to $15,000 for a first offence and up to $25,000 for subsequent offences, compared to a $10,000 maximum fine under the Trespass to Property Act.
  • Allowing the court to order restitution for any injury, loss or damages suffered as a result of the offence. This could include loss of livestock to stress or disease or loss of food due to safety protocols not being followed and potential contamination.
  • Prescribing aggravating factors that would allow the court to consider factors that might justify an increased fine. If the court chooses not to increase the fine based on the aggravating factors they must provide reasons for their decision.
  • Increasing protection for farmers against civil liability from people who were hurt while trespassing or contravening the act as long as there was no intent to do harm or reckless disregard.
  • Increasing safety around livestock transport trucks
Concerns have been raised about people in close proximity to moving trucks or attempting to stop them on a public roadway. As well, interacting with animals in transport can cause unnecessary additional stress and risk introducing contaminants. The proposed legislation would address this by:
  • Prohibiting the stopping, hindering, obstructing or interfering with a motor vehicle that is transporting farm animals.
  • Prohibiting interfering or interacting with farm animals being transported by a motor vehicle without explicit prior consent.
  • Making it easier to prosecute trespass
The legislation would be an additional tool for law enforcement and would make it easier for Ontario's legal system to prosecute individuals for offences as it would: 
  • Require that a person have explicit prior consent before entering an animal protection zone.
  • Invalidate consent if it was obtained under false pretense or duress.
  • Expand the limitation period in which charges can be laid to two years from the day of the offence or two years from the day when evidence of the offence was uncovered. This compares to a limitation of six months under the Trespass to Property Act.
Protection of animals under the proposed Act
The health and welfare of animals is important to all of us but trespassers may unknowingly endanger them. The proposed legislation would maintain and enhance animal health by:
  • Reducing the risk of animals being exposed to stress and disease by trespassers.
  • Including exceptions to allow access for those enforcing animal welfare legislation, as well as emergency personnel, federal and provincial inspectors, municipal by-law officers and other authorized people.
  • Containing a clause to allow the reference to animal welfare legislation to be updated to the Provincial Animal Welfare Services (PAWS) Act if both are passed by the legislature.
  • Addressing additional risks specific to farms and agri-food premises
The proposed legislation would establish additional offences to address challenges and risks specific to farms, agri-food premises and farm animal transport including:
  • Entering into prescribed areas of a farm or processing facility without explicit prior consent;
  • Failing to comply promptly with a request to leave the premises or stop interacting with animals from the owner or occupier of a farm or food processing facility.
  • Failing to comply promptly with a request from the driver to stop hindering or obstructing a livestock transport vehicle or to stop interfering or interacting with the animals
  • Providing false or misleading identification; and
  • Defacing, altering, damaging or removing any signs that have been posted to identify prescribed areas where farm animals are kept.

This proposed legislation does not affect:
  • Indigenous hunting and fishing rights on rural land outside of an animal protection zone, and
  • Existing specific provisions under the Trespass to Property Act.

They report: "Another 5,000 cows needlessly murdered, overlooked by the very people who will be ingesting and wearing their tortured bodies. But we were there, to see them and to grieve them. To offer them kindness in their final dreadful hours."

Ditch Dairy SAVE Lives aims to encourage Save groups (existing and new) to hold vigils outside of dairy farms or factories incorporating outreach. Groups can also do outreach outside of establishments retailing large amounts of dairy products.

Melbourne Chicken Save & Melbourne Duck Save held a "Bear Witness To The Innocent" event at the popular Bourke Street Mall on December 1. It was a tribute and city vigil to commemorate the billions of innocent souls whose lives are taken each year unnecessarily by the animal abusers and exploiters in the “poultry” factory farming industry.

Whanganui Animal Save held a vigil at Land "Meats" slaughter plant on November 24. ORganizer Sandra Isable wrote: "In a weekend where activists in New Zealand's main centres held supermarket disruptions with the message CLOSE ALL SLAUGHTERHOUSES, I'll keep my commentary short and let the photos of these precious girls and boys speak for themselves."

FRANCE
At Toulouse Animal Save's vigil at the Montauban abattoir, close to 100 farmers attacked the peaceful activists, as seen in this video. 
"One hundred farmers met in front of the slaughterhouse to prevent us from showing the fate of the animals. Resigned to militate without risk, we made the choice not to go past the slaughterhouse and stay at the roundabout, 200 meters away, to avoid confrontation. A few minutes passed and prowlers contacted those who are waiting to come and 'find us.'"

Animal Save Skaraborg released this unique video. "It was given to us by a slaughterhouse worker who wanted to expose the cruelty of his place of work. Two days ago we showed an edited film of his materials at one of the walls of a building of the slaughterhouse where it was filmed. Animal Save Skaraborg will release it online divided up in four parts. The first one, in English, you can see here."

Save Movement Scotland report from their December 1 vigil at Sandyford Abattoir: "Today we witnessed two large trucks and four or five smaller trailers that were full of sheep. The weather was -1 degrees. I cannot imagine how those animals were feeling. They seemed very frightened and anxious on the way towards the gates. Grateful for the drivers willing to stop for us and recognising us as a peaceful movement. Until every cage is empty."

Cancún Fish Save held their first vigil on November 30. They report: "We entered a supermarket to spread information  where they have fish tanks with live lobsters waiting to be killed, as well as bodies of fish and mollusks that were kidnapped from their habitat for human benefit."

Welcome SW Missouri Animal Save.  Find them on Facebook and Instagram
They had their first vigil on November 27, for the turkeys at the Butterball slaughter plant. Butterball is a widely known brand of murdered turkeys. They report: "Rest In Peace, sweet babies. We watched you sit in the freezing weather with little room to move in the cages. We watched you be taken in to the slaughterhouse, and we watched the trucks return empty. We saw you. We loved you for those few minutes. We will continue to fight for you."
They saw trucks full of the innocent turkeys go in.

 
O‘ahu Animal Save held a vigil for the pigs on November 19. "She’s looking for a way out, but there isn’t one. It’s inevitable that she will get scared out of this trailer, and forced into the kill line. A human will pull the trigger to stun her, she will be lifted up by her hind legs, and her throat will be sliced open. She will thrash while her blood drains out. The process will happen next to her friends who just watched it happen to her, and there is no escape. This is hell on Earth, and we (humans) are behind it."
