BODY CORPORATE NEWS

PARCEL DELIVERY OVER THE CHRISTMAS PERIOD

It is quite sad that parcels left in the mail room (because they don't fit into the boxes) have "disappeared" from a number of apartment blocks.  CCTV footage has not been able to identify the culprits and we strongly recommend that if you are expecting a parcel give the courier instructions to leave a delivery note in your letter box so that you can pick it up personally.

The Crescent Apartments   
Charta has resigned as Body Corporate Managers:  You should be aware by now that Charta resigned as the body corporate managers for The Crescent Apartments, but we still look after the building management.  If you have any queries regarding body corporate issues contact your BC Committee Chairman or Barfoot & Thompson Body Corporate.
Building Management: As the building manager, we keep an eye on the general maintenance and cleanliness of the building and sort out the day to day issues so that the building WOF is kept current etc.  When there are issues that need to be sorted out like the recent destruction of the front door, we notify the Body Corporate of the problem, obtain quotes and organise the contractors to fix it and notify the residents of the problem and how it may impact them. 
CCTV - is now in operation.

Forte Apartments  
Rubbish Room:  The ongoing problem with exiting tenants dumping unwanted furniture and excess rubbish in the bin room and stairwells.  Tenants managed by Charta are aware of the rules and fines in place, unfortunately not all tenants are managed by us and sadly some people just don't care.  It can be difficult to find the offenders and can cost the body corporate up to $300 to have it removed.  If you notice anyone doing this please let us know.

Haven 
We recently has the plumber out to the Haven apartments to clear a blockage after reports that there were problems with flushing of the toilets.  It turns out the problem was due to wet wipes being flushed down the toilets, getting caught and blocking the mainline between the two man holes for the apartments.   We have notified all residents that wipes are not to be flushed.  They do not break down or break up once flushed (most are made from plastic based fabric).  It seems that this is a growing problem across the city.  Not just here.

Now that construction is complete the new canopy over the entry has been installed and we will be working our way through the list of maintenance issues for the building over the coming months.

GENERAL
Ageing appliances: A lot of washing machines, range-hoods and waste disposals are coming to the end of their life and need replacement.  Some of the original machines installed are now obsolete and parts are no longer available.  We are lucky to have an appliance guy who is able to source decent quality replacements at a really good price (cheap!) and because he has been working with us for a number of years, knows the requirements and has no problems with installation.  If you haven't already been effected by this it may pay to put a note in your diary to budget for this over this next 12 months.
 
LOCKED OUT!  Unfortunately apartment owner occupiers have the same problems and costs associated with being locked out.  In some cases we may be able to help you out.  If it's during the working week between 9-5pm, one of our staff may be in the area or even in the building (inspections or viewings).  Sorry to say that in most cases we will still have to charge a fee to cover any admin, travel time, parking costs etc. but it really does depend on the situation so give us a call before you ring the locksmith and it will probably cost you a lot less.

THE REINZ MONTHLY PROPERTY REPORT

New record median house price for NZ & 10 regions. Auckland highest price for 32 months

Today, REINZ is releasing its Monthly Property Report and HPI Monthly Data which provides a market leading level of detail and understanding of housing activity in New Zealand. The Monthly Property Report has shown median house prices across New Zealand increased by 8.6% in November to a new record high of $630,000, up from $580,000 in November 2018, and 10 regions saw record median prices .
Bindi Norwell, Chief Executive at REINZ says: “November was a very strong month price wise, with record median prices seen in 10 regions and a record equal in Manawatu/Wanganui. This is the highest number of regional records we’ve seen in a single month since March 2005. Additionally, the country saw a new national record median price of $630,000 and 24 territorial authorities around the country saw record median prices including Whangarei District, Auckland City, Tauranga City, Napier City, Kapiti Coast District, Lower & Upper Hutt Cities, Nelson City, Christchurch City, Dunedin City and Invercargill City."
“The Auckland market has seen prices increase for three months in a row, suggesting that we’re now entering a new normal for the country’s biggest real estate market where the increasing levels of confidence in the property market coupled with low interest rates and a lack of choice of new listings means that people are prepared to pay more for properties than they were a few months ago. The median price for Auckland represents a $22,000 increase since last month and is the highest price in 32 months,” continues Norwell.

The number one advantage between REINZ data and other housing data on the market is that REINZ has access to sales data from the time the price is locked in (unconditional data) as opposed to when the house changes hands (settlement date) which can often be weeks or months later. Therefore, REINZ data is the best and most timely measure of recent housing market activity.

IS YOUR INVESTMENT PROPERTY INSURED?

Just recently, a major amendment to the Residential Tenancies Act 1986 was announced stating that insurance details from landlords will need to be stated on future Tenancy Agreements. This is just one of the many legislative updates announced this year alongside the Healthy Homes Standards.  Our team is working to ensure that all landlords/owners are aware and where necessary will help organise the required information for all new tenancies.  
 

New laws for careless damage

New tenancy legislation was passed on 24 July 2019 which will affect landlords and tenants in a number of ways. Landlords and tenants will both benefit from a Bill that clears up liability for careless damage to a rental property.

“This Bill makes practical changes to the Residential Tenancies Act 1986 to help ensure our tenancy laws better reflect responsibility for careless damage of rental properties,” Associate Minister of Housing Kris Faafoi said. “These changes will provide greater certainty to landlords, minimise cost and risk, and ensure tenants have the right information when deciding if they will rent a property,” said Kris Faafoi.

Landlords will need to provide insurance information in any new tenancy agreement, including whether the property is insured and if so, what the excess amount is. The statement in the tenancy agreement must also inform the tenant that a copy of the landlord’s insurance policy is available on request.
 

Unlawful Tenancies

The Bill also deals with unlawful residential properties, such as illegally converted garages or sleep-outs, by ensuring the rights and responsibilities under the Residential Tenancies Act are applied. The law for prosecuting landlords who tenant unsuitable properties is also strengthened under this Bill.

“We are improving our tenancy laws so that tenants and landlords are protected and can have clear expectations before going into a tenancy… through this Bill, we are committed to making sure that tenants are living in safe homes while also making sure properties are not being vacated when the risk is low.” Kris Faafoi said.

These changes are scheduled to take effect on 27 August 2019. We will be working with you to ensure deadlines are met.

Heating & Insulation Update

 

This is a timely reminder to the very few investors that have not yet insulated their properties that compliance to the Healthy Homes Bill is part of your responsibilities as a landlord and we will not manage your apartment if it does not meet the requirements.

Heating is the other major requirement that is also part of the Healthy Homes Bill. MBIE Tenancy Services outlines the need for providing heating in the living room as it’s stipulated in the 1947 Housing Improvement Regulations and its amendments – this requirement is taken seriously at Tenancy Tribunal and there have already been quite a number of fines.

Tax implications: What can you claim?

When tax time rolls around, you might be able to claim some of the money you spent on making sure your rental property meets the healthy homes standards. But there are a few things to consider first.

Topping up old, worn-out insulation could be regarded as a deductible expense. But putting in new insulation for the first time or installing a new heat pump, when there wasn’t one there before, could be regarded as a property improvement. That would make it a capital expense, which means you can’t deduct it from your rental income.

Inland Revenue has more information about managing your rental property and guidance about what you can and can’t claim at tax time. The difference between repairs and improvement can be tricky and it’s important to get it right, so it may be helpful to chat to a tax agent if you’re unsure about your specific situation.
