Federal judge in Seattle to hear Washington’s border wall challenge today

SEATTLE — Media are advised of a court hearing today in Attorney General Bob Ferguson’s legal challenge of the Trump Administration’s plan to “reprogram” nearly $89 million in congressionally approved military construction funds meant for Naval Base Kitsap in Washington to help build a wall along the U.S. southern border.

Two federal judges — one in Texas and one in California — previously issued injunctions blocking the border wall project, but those injunctions have since been lifted. AG Ferguson’s case is primarily focused on protecting the funding Congress appropriated for Washington projects from unlawful seizure, but could also result in a nationwide ruling preventing the Trump Administration from abusing its authority by repurposing congressionally approved funding for the border wall.

A bipartisan group of more than 100 former members of Congress, the U.S. House of Representatives, and 60 former national security and State Department officials who served presidents of both parties have filed briefs with the court in support of the legal challenge.

Washington Assistant Attorneys General Andrew Hughes and Brendan Selby will present the state’s case. Attorney General Bob Ferguson will be in the courtroom.
